Council Minutes of 6/5/84 -~- <br />Under Old Business (cont'd): <br />~` Mrs. Petrigac also asked if the Legislabionn Committee would discuss Ordinance No. <br />84-41, relating to establishing the procedure for non-partisan elections, as well <br />as Ordinance No. 84-8, relating to the filling of a vacancy in Council, and bring <br />them out of committee for Council's consideration. <br />Mr. Bierman complimented Service Director Corrigan and the entire Service Department <br />for their good work in taking care of the horrendous job of filling chuckholes in <br />the City. <br />President Boehmer reported many telephone calls with respect to the awarding of the <br />contract for the work to be done at the Wastewater Treatment Plant. He stated that <br />while Council does provide funds for various projects and purchases, it has absolutely <br />nothing to do with awarding the contracts. The Board of Control makes the decision <br />and awards contracts to the lowest and best bidder. Council provides the money; <br />Board of Control awards the contract. Council does not attend the Board of Control <br />meetings nor is it consulted during the consideration of the bids.. Would like to <br />make this clear since some people are unaware of how the process works. <br />Service Director pointed out that the Board of Control is governed by the laws of <br />the community, the laws of the State of Ohio in making recommendations and awarding <br />contracts, particularly when there are matching State or Federal funds. Has pro- <br />vided information to Council as to what the bids were on any particular item and <br />has certainly given mature consideration. to any comments, suggestions or observations <br />made by Members of Council. With respect to the Wastewater Treatment Plant, the <br />bid packet had to have State and Federal EPA review to be sure laids met all requisite <br />Federal and State requirements. <br />Mayor Swietyniowski added that not only do they have to meet Federal EPA standards <br />but in this case they had to be approved by the Army Corp of Engineers. <br />Mr. Logan reported that the bid had to be awarded to the lowest and best bidder; <br />legally, the Board of Control could do nothing else. The bid was approved by <br />Dalton, Dalton, Newport, the U.S. and Ohio Environmental Protection Agency as <br />well as the Army Corp of Engineers. The matter with respect to unionism could not <br />legally be considered by the Board of Control. <br />Mr. Wilamosky asked when Council would be supplied with the detail that is re- <br />quired in Ordinance No. 84-44. Mr. Logan advised that the detailed booklet should <br />be completed within the week; will get a copy to Mr. Wilamosky. <br />Mr. Wilamosky moved Council excuse the absence of Councilwoman Saringer, second by <br />Mr. Bierman, unanimously approved. <br />There being no further business, President Boehmer adjourned the Council Meeting at <br />9:30 P.M. <br /> ~ <br /> 6 <br />lorence E.
