Council Minutes of 4/17/84 -2- <br />the City has no record of receiving. In 1982 this amounted to $10,713 and in <br />1983 amounted to $2,240. City shows about $500 for last year; RTA agreed to <br />take that out of the audit. These figures increase the cost per mile and that <br />it the reason for the City's concern. Also, in reviewing RTA records, they showed <br />things such as toilet paper, paper towels, etc. which the City does not buy <br />through RTA. <br />3) Westshore Cable Television has issued its financial statement and it has been <br />reviewed by Finance Director. City is still owed $182.81, mainly due to rounding <br />errors, and this check will be issued along with the first quarter - 1984, check. <br />This financial statement does conform with discussions held last year and shows <br />not only the receipts and expenditures of the entire partnership but also breaks <br />them down per Westlake and North Olmsted. They did have a loss which was not <br />completely unexpected. <br />4) With respect to the $5,315,000 note recently passed, City has closed with <br />McDonald and Company at a rate of 6.68% on a six month note. Will be meeting with <br />Council, McDonald and Company, Dalton, Dalton, Newport and Squire, Sanders and <br />Dempsey next Monday on the sewer project and will finalize all the financing on it. <br />Has had meetings with Dalton, Dalton, Newport, Squire, Sanders and Dempsey and <br />the Army Corp of Engineers on Phase III of the sewer. project; have reviewed the <br />contract, City's obligations, obligations within City departments and are ready to <br />proceed after meeting with Council. <br />Law Director Gareau reported: 1) Has received a ruling from Judge Bell, in favor <br />of the City, in the Dinunzio Case. If he feels that he is aggrieved further, <br />Mr. Dinunzio has the right to appeal to the Sixth Circuit Court. <br />2) Has sent to Council a memo with. respect to a reported case out of Illinois <br />dealing with 1983 actions. Had similar cases in the City of North Olmsted a number <br />of years ago. In the past several months, has seen opinions coming from counsel, <br />other than the Law Department, regarding the potential liability of the City. The <br />North Olmsted Law Department has proved-that it knows how to try a case and knows <br />what the issues are. Would like to point out again that when the City has an <br />elected official who has reviewed these issues, consideration has to be given to <br />the fact that he has tried these cases, knows what they are about, and when there <br />is any potential liablility to the City, the advice has to come from the North <br />Olmsted Law Department and not outsiders. Thinks the problem the City had regarding <br />the Rini property has been resolved but should be kept in mind because when such <br />problems occur they have to be looked at twice. The City of North Olmsted could <br />never sustain a loss of $29,000,000 as was reported in the Illinois case. <br />Mr. Bierman, Chairman Long Range Planning Committee reported: 1) Attended the <br />Public Hearing for CDBG money at the Senior Citizens Center on April 5th. In <br />attendance were approximately twenty-four citizens, Councilwoman Petrigac, Council- <br />man Wilamosky and Administrative Assistant Mary Slama. Avery good presentation was <br />given and well received by the audience. <br />2) Long Range Planning Committee met on April 10th with Councilwoman Petrigac and <br />HRD Director Don Copeland also in attendance. All Council Members have received a <br />packet showing the project submissions as of April 10th. Twenty-four items were <br />submitted; sixteen of which concerned street and drainage improvements. Some other <br />suggestions covered store front improvement programs for Lorain Road; Old Town Hall <br />rehabilitation; Charles B. Lewis Pemorial Park; Horizons After School Center; <br />Chestnut School; Korea and Viet Nam War Memorial at North Olmsted Park; improvements <br />to the Community Cabin (wiring and assorted rehabilitation needs); Senior Center <br />restrooms (accessability for handicapped) and Senior Citizen housing.
