Council Minutes. of 2/21/84 _2_ <br />Law Director Gareau reported: 1) Received notice that the Unemployment Board of <br />Review denied Mr. Zurawski's further appeal. The next step, if there is to be <br />any further appeal at all, is in Common Pleas Court. <br />2) Had thought the Vicaroni Case was all over, however, received notice this week <br />that the man who was with Mr. Vicaroni twelve years ago, and was also arrested, also <br />wants his arrest record expunged. Will probably be hearing more on this in the future. <br />3) Law Director had filed a request for findings of fact and conclusions of law on <br />the Jandecka appeal dealing with the dog case. Will also file a notice of appeal on <br />this case on Thursday. As he did in the last case, Judge O'Donnell refused to give <br />findings of fact and conclusions of law. The case was reversed and sent back and the <br />Judge again refused to give findings of fact and conclusions of law even though the <br />Law Director had prepared and sent them to him. <br />4) Attended the Municipal Law Seminar, Cuyahoga~County Law Directors' Association, <br />and will also be attending, for the second time, a collective bargaining seminar. <br />5) Has filed an application to be admitted to the United States Supreme Court in <br />anticipation of the RTA appeal which will be filed next week. <br />6) There are two Romp Cases - designated .Romp I and Romp II; both dealing with <br />rezoning. Has filed a motion to dismiss in the first case; had a pretrial this <br />past week and the Judge indicated he will grant the motion to dismiss. <br />Safety Director Petre reported: 1) In discussing the purchase of 1984 police vehicles <br />with the fleet manager of Chrysler Corporation, was advised the order should be placed <br />by April 1st and certainly no later than April 15th. <br />2) Last night, Recreation Commission had a special meeting. North Olmsted Softball <br />Association developed a written proposa]. to rehabilitate Diamond No. 4 at a cost of <br />between six to ten thousand dollars. The Association will utilize Diamond No. 4, <br />Monday through Thursday, from 6 P.M. until dark. .Recreation Commission unanimously <br />accepted and. approved this offer as presented by President Tom Stevens and First Vice <br />President Keith Lockner. <br />Mrs. Saringer, Chairman Tntra-Governmental Relations and Legislation Committee re- <br />ported: 1) Recreation Commission met on February 14th. Mr. Bob Dauer reported that <br />between 650 and 700 boys registered for the Hot Stove League this year. Mr. Ulewicz <br />stated that NOSO has registered 1100 to 1200 children; also have a new program <br />called "Little Kickers" for youngsters from 6 to 8 years of age, with approximately <br />two to three hundred registered for this program. Mr. Couts reported an income of <br />$110,374.59 for January; 1984; best income month ever. Tennis revenue is down. <br />Pro Shop and Pro Shop inventory report as well as the concessions report were given. <br />Mrs. Saringer gave a brief beautification report for the front of the Rec Center. <br />It was decided to table this project until the drainage problem was resolved. <br />Mr. Petre recommended to build the budget excluding the $36,000 Council agreed to <br />appropriate to subsidize the Center; Commission members agreed. After checking into <br />contracting janitorial service, it will be less expensive if the City would hire <br />another full time janitor. Landscaping service is also too expensive; will be cheaper <br />to hire summer part time help. Mr. Petre moved to approve the following equipment <br />purchase and capital improvements: concession tables and chairs, $2,600; maintenance <br />vehicle, $13;000; rental skates, $2,000; skate sharpener, $900; security lighting, <br />$1,200; picnic tables and players' benches, $1,386; total $21,086. Capital improvements <br />will include energy study, $4,980 and others to be determined, in an amount of $12,020, <br />for a total of $17,000. Motion was seconded and .passed three to two. Last night, <br />a special meeting was held. Tt was pointed out that the motion did not include the <br />words "to approve the budget". Another vote was taken, approving the budget and in- <br />cluding the line items. The vote was 2/Z and therefore did not pass. <br /> <br />
