MINUTES OF THE MEETING OF THE .COUNCIL <br />OF THE CITY OF .NORTH OLMSTED <br />NOVEFffiER 6, 1985 <br />Present: President James Boehmer, Councilmen Bierman, O`Grady, Petrigac, <br />Rademaker, Saringer, Tallon, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8:05 P.M., in Council ,Chambers, <br />5200 Dover Center Road. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of Regular Council Meeting of October 15, 1985, were approved. <br />Minutes of Special Council Meeting of 0 ctober 24, 1985, were approved. <br />President Boehmer announced the addition of the following pieces of legislation to <br />this evening`s agenda: <br />(1) Ordinance No. 85-116, accepting. an easement for the installation and maintenance <br />of a water main to supply water services to .Christ ,the King Community. <br />(2) Ordinance No. 85-117, accepting an easement €or the installation and maintenance <br />of a water main to circulate water to Christ the King Community. <br />(3) Ordinance No. 85-118, accepting a sanitary sewer easement located on property <br />occupied by the Great Northern Technology Park Building. <br />(4) Resolution No. 85-119, advertising and accepting bids for .the removal and re- <br />placement of existing box culvert which crosses McKenzie Road. <br />(5) Ordinance No. 85-120, ratifying and confirming the cost of emergency repairs to <br />the settling tanks at Wastewater Treatment Plant and financing same. <br />(6) Ordinance No. $5-121, extending the existing BFI agreement for one year for <br />refuse pickup. <br />Law Director Gareau reported: Romp Rezoning Case will be tried on Tuesday, <br />November 12th; although the City is .the defendant in the case, Law Director will <br />be calling a zoning expert, a traffic engineer, and an appraiser, as well as <br />City Engineer Schaller, Building Commissioner Gundy and one resident from the area. <br />2) Latest Zurawski Case was turned .over to the insurance company,. who refused to <br />defend the city, indicating .that because there was a previous case dealing with <br />Mr. Zurawski, and they were not notified, that the terms of the insurance contract <br />were somehow violated. Law Director thinks this is probably one of the most <br />ridiculous arguments he has heard and upon receipt of a copy of .the policy, will <br />proceed against the insurance company through arbitration or through the court system. <br />3) Last Friday, Law and Assistant Law Director attended a one day seminar dealing <br />with 1983 actions against municipal corporations. <br />4) Mayor, Service Director and Law Director will meet with RTA and NOACA this coming <br />Friday to discuss the ground rules for the audit that will take place before next May. <br /> <br />
