MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />JUNE 18, 1985 <br />Present: President James Boehmer, Councilmen Bierman, Petrigac, Rademaker, <br />Saringer, Tallon, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Absent: Councilman O'Grady. <br />Meeting was called to order by President Boehmer at 8:15 P.M., in Council <br />Chambers, 5200 Dover Center Road. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the Council Meeting of June 5, 1985, were approved. <br />President Boehmer announced that Ordinance No. 85-69, advertising for bids for <br />diesel fuel and gasoline, as well as Ordinance No. 85-70, commending the achieve- <br />ment of Eagle Scout Award in Boy Scouting by Brian Rector, were being added to <br />tonight's agenda. Also, Ordinance Nos. 85-52, 85-53 and 85-54 were being removed. <br />Law Director Gareau reported: 1) The Sixth Circuit Court ruled that the city was <br />not entitled to a stay in the Cooper Case and consequently the order of the lower <br />court judge to reinstate Ms. Cooper pending the appeal is in effect and she was <br />placed back on a thirty day training program as of yesterday. After this thirty <br />day period, she will go into the regular, on-the-road service. Law Director has <br />received the briefing schedule on this case: mid-July must have the city's brief <br />and assignments of error to the Sixth Circuit Court. Then, in turn, the appellee <br />will have an additional twenty days in which to file their brief in opposition. <br />Law Director will then have an opportunity to file a reply to their brief in <br />opposition. Will probably schedule this for argument in the Fall. <br />2) This coming Friday, will have the trial with respect to the Zurawski Case. <br />This is the case dealing with the interpretation of the city's charter as to <br />whether or not Mr. Zurawski held the status of a civil service employee or the <br />status of a director, whereby Council would have had to remove him. The city <br />had won the case in the lower court; it went to and was reversed by the Court of <br />Appeals; regardless of what happens now, will be back up to the Cotrrt of. Appeals. <br />Finance Director Boyle reported: 1) Has received confirmation that two workmens' <br />compensation claims are being reversed, either in total or in part, stemming from <br />an annual review of claims filed against the city. Will be receiving $3,440 in <br />reimbursements and also lowering of the city's risk. <br />2) Has talked to McDonald and Company as well as Squire, Sanders and Dempsey <br />concerning the $3,529,000 notes coming due in September. Has given them in- <br />structions to start the legislation for the reissuance; will also be paying off the <br />$54,000 safety equipment notes as agreed to earlier. Bonding process will be as <br />of November 1st in order to earn about $8,500 in arbitrage profits. <br />3) Asked to be excused at this time in order to attend the Charter Review <br />Commission meeting in the small caucus room. Permission was granted. <br /> <br />
