MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MAY 7, 1985 <br />Present: President James Boehmer, Councilmen Bierman, O'Grady, Petrigac, <br />Rademaker, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Absent: Councilwoman Saringer and Councilman Tallon. <br />Meeting was called to order by President Boehmer at 8:10 P.M., in Council Chambers, <br />5200 Dover Center Road. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the regular Council Meeting of April 16, 1985, were approved. <br />Minutes of the special Council Meeting of April 22, 1985, were approved. <br />President Boehmer announced: 1) Three pieces of legislation are being added to <br />tonight's agenda: Ordinance No. 83-61, accepting for recording purposes only the <br />7515 Company's Subdivision No. 2; Ordinance No. 85-50, accepting an easement for <br />the installation and maintenance of a water main for the purpose of supplying <br />water service to 7515 Company`s Subdivision No. 2; Ordinance No. 85-51, creating <br />a capital improvement fund entitled "Infrastructure Fund". <br />2) Councilwoman Saringer's absence is due to the death of her sister; Councilman <br />Tallon's absence is due to a work schedule change. <br />Law Director Gareau reported: 1) Since the last council meeting, the judge has <br />ruled on a request for a stay in the Cooper Case. Law Director had requested the <br />court to stay judgment relative to back pay as well as the order to have Miss <br />Cooper reinstated. Judge Aldridge granted the stay regarding the back pay order <br />but did not grant the stay with respect to Miss Cooper resuming her normal duties. <br />Mr. Gareau has prepared a brief and a motion, filed with the Sixth Circuit Court, <br />and is awaiting a ruling. Had a two and a half hour telephone, four-way conference <br />with the Sixth Circuit Court to determine what the issues are and whether or not <br />any of them could be settled. <br />2) With respect to the Burger King Case, pending in Common Pleas Court, because the <br />attorney failed to include the Attorney General as a party to the case, it was dis- <br />missed; case was refiled and has already been before Judge Jones. Pre-trial was <br />held last Friday; this past Monday the motion for summary judgment was argued before <br />the court and preliminary injunction was also argued. Expects court's ruling in the <br />near future. <br />3) Law Director and Mayor appeared at the Regional Transit Authority board meeting <br />this morning; Mayor did a fine job of arguing the City's case; Law Director argued <br />some of the legal aspects. <br />Mr. Bierman, Chairman Long Range Planning Committee reported:, 1) Public Hearing on <br />Community Development Block Grant Funds was held on May. 2nd; approximately twenty <br />people in attendance as well as President of Council Boehmer, Councilmen Bierman and <br />O'Grady. Roughly seventeen suggestions for the use of CDBG funds were made. Funding <br />for fiscal year 1985 amounts to $68,827; seven years ago that amount was $117,000, so <br />there is quite a bit of difference now in the funding. <br />
