r <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MARCH 19, 1985 <br />Present: President James Boehmer, Councilmen Bierman, O'Grady., Petrigac, <br />Rademaker, Saringer, Tallon, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8:05 P.M., in Council Chambers, <br />5200 Dover Center Road. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the regular Council Meeting of March 5, 1985, were approved. <br />Minutes of the special Council. Meeting of March 12, 1985, were approved. <br />President Boehmer announced that Resolution Nos. 85-27 through 85-32, covering paint, <br />asphalt, concrete reflective traffic signal and roadway marking materials, stone and <br />oil and lubricants are being added to tonight's agenda. <br />Mayor Swietyniowski reported: 1) The North Olmsted Transportation Study Group met <br />last Saturday; general discussion covered roadway widening to rail links to down- <br />town Cleveland and the importance of planning for the .future. There are growing <br />demands on the existing transportation system and failure to prepare for future con- <br />gestion will have severe economic and social impact on the city. Committee will in- <br />vestigate all options and work to implement the most appropriate resolutions. <br />2) The closing of relocated Route 252 has been delayed approximately 4/6 weeks; will <br />keep Council informed. <br />Law Director Gareau reported: 1) '!'he Zurawski Case, dealing with interpretation of <br />the City Charter, will be on for trial on June ?_1, 1985. <br />2) A pre-trial will be held tomorrow morning in Judge Manos' room with respect to the <br />Kennedy Case. By next Council Meeting, Law Director expects to be able to report <br />that the City of North. Olmsted is no longer involved in the case. <br />3) Pre-trial with respect to Ben Wright was held this morning; another pre-trial has <br />been set for next Tuesday. <br />4) A trial has been scheduled for April 4th with respect to the D'Auito Case, dealing <br />with the sewer easement and some allegation that the City had taken property without <br />compensating the owner. Trial is expected to last a couple of days. <br />5) With respect to the Luwanna Cooper Case, has filed a notice of appeal; filed a <br />motion to stay. Is waiting for the judge to rule on the motion to stay. Requested <br />two things to be stayed - the judgment amount dealing with back wages as well as the <br />motion for reinstatement. Has also asked the court to waive the City being required <br />to file a supersedeas bond. Has an affidavit from the Finance Director stating that <br />the City has sufficient assets, if needed, to pay such a judgment. If the court re- <br />fuses to permit waiving the supersedeas bond, has forwarded to Finance Director Boyle <br />the necessary financial data and has contacted the bonding company so the City can <br />make application for the bond. <br />
