Council Minutes o~ 3/19/85 -2- <br />Finance Director Boyle reported: 1) Approximately a month ago, had mentioned that <br />,~` he was trying to correlate all the data to introduce the May 1st note roll-over at <br />`~` tonight's meeting, in order to have three full meetings on the legislation. Has not <br />been successful in contacting Mr. Kuhn, although he has contacted Peter Ross at <br />McDonald and Company. Has requested a meeting since he is unsure what the interest <br />rates are going to be; if the City is delayed, waiting for an audit, it would not <br />be advantageous since most economists agree that rates will be rising during the <br />summer. Would hate to end up with the higher rates; may just- roll the notes over <br />or go to bonds. <br />Mrs. Saringer, Chairman Legislative Committee reported: 1) Committee met on March <br />12th to discuss Resolution No. 85-25 and Resolution No. 85-26. Resolution No. 85-25 <br />opposes the proposed 3notor vehicle emission inspection and maintenance program for <br />the State of Ohio. The annual inspection would cost approximately $35 per vehicle, <br />not including the cost of any repair and maintenance to the emission systems of the <br />vehicle. Committee is not in favor of passage of this resolution. <br />2) Resolution No. 85-26 urges General Motors to locate its Saturn Division in Ohio, <br />with preferable consideration being given to Cuyahoga County. Commmittee recomdnends <br />passage of this resolution. <br />Mr. O'Grady, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Committee met March 1?.th to review Ordinance No. 85-11, as amended, dealing with <br />child pornography possession. In attendance were Councilmen Petrigac and Bierman <br />as well as Acting Chief Marsh and Law Director Gareau. Law Director pointed out <br />that the Ohio Revised Code was revised last Fall and deals with three sections: <br />pandering obscenity involving a minor; using a minor in nudity; endangering children. <br />Before the amendments, Ordinance No. 85-11 was too vague and left out important <br />characteristics that would make it enforceable. The amended ordinance specifically <br />states, "no person with knowledge of the character of the material shall possess or <br />control any material which depicts a minor under the age of sixteen years engaged in <br />sexually explicit conduct". It defines sexually explicit conduct in detail. Also, <br />it changes the age of the minor from "under eighteen" to "under sixteen" because of <br />a recent Supreme Court ruling that makes it even more enforceable at this age level. <br />Eliminated from the revised ordinance that would give the following groups the right <br />to possess pornography were the following: a bona fide artistic, medical, scientific, <br />educational, religious, governmental, judicial or members of the t+~dical profession <br />pursuing bona fide studies or research. Also removed was that the person knows that <br />the parents, guardians or custodians have consented in writing to the photographer <br />in use of the minor in the state of nudity and to the manMer in which the material <br />is used or transferred. Acting Chief Marsh stated that to his knowledge only one <br />case of this type has come up in North Olmsted. He stated also that he was totally <br />in favor of this ordinance and felt it to be very enforceable. Committee unanimously <br />supports passage of Ordinance No. 85-11, as amended. <br />.Mrs. Petrigac, Chairman Public Parks and Buildings Committee as well as Transportation <br />Committee reported: 1) Recreation Committee Meeting was held Monday, March 18th, with <br />Mrs. Petrigac, Safety Director Petee, Complex Manager Couts and Chairman of Recreation <br />Commission, Mr. O'Rourke in attendance. Mr. O'Rourke gave an excellent report, copies <br />of which have been passed out to Council members. The report deals with how he sees <br />the finances for the Recreation Complex, with a long range plan as well as a listing <br />of current and immediate needs. He has found the figures are not accurate as they <br />do not reflect totals in programs; they are line item figures rather than what the <br />entire program costs. Many items fall through the cracks or are put into the general <br />account rather than into a program. He will use the first quarter of 1985 to compile <br />all the totals and will then come back to Council. He is working with the treasurer <br />of the school system, Mr. Bettendorf, to go over the figures, compile them for the <br />first quarter of 1985 and then each succeeding quarter.
