<br />Council Minutes of 12/16/86 -2- <br />6) Has asked Legislative Committee Chairman to consider Mr. Remmel for re- <br />appointment to the Board of Zoning Appeals and Bob Galloway for the Board <br />of Building Appeals. <br />7) Council Chamber Christmas tree was decorated by Cub Scout Pack. 52 and <br />Boy Scout Troop 53; all ornaments were made by the scouts. <br />8) Received a letter from the County. Commissioners urging the administration <br />to provide testimony in regard to the impact federal cuts have on local <br />government. The meeting was held on December 12th; Mayor and Budget and <br />Management Director were unable to attend.. Mayor asked Finance Director <br />Boyle, by memo, if he would attend and he will report out. <br />9) December 9th, a bomb threat was reported to the North Olmsted Police <br />Department by St. Richard's school; immediate evacuation of an estimated 500 <br />students and faculty members was necessary.. Police Department requested <br />the North Olmsted Municipal Bus Line to provide transportation from St. Richard's <br />to St. Clarence. Manager Ken Mues and his staff immediately mustered NOMBL <br />personnel, drivers, mechanics, dispatchers, administrative personnel, and <br />Service Department personnel to safely transport the children to St. Clarence. <br />The administration has received many thank you notes from the children and <br />staff at St. Richard's for the professionalism displayed by city personnel. <br />Mr. Wilamosky stated that he did have an opportunity to talk with NOACA and <br />was surprised that they had submitted a proposal; he did not realize that <br />one had been received by the Mayor. Mayor Petrigac replied that she had re- <br />ported receipt of the NOACA proposal at the last council meeting; all <br />proposals are in her office for council's examination; they can be xeroxed <br />if Council wishes copies. <br />Law Director Gareau reported: 1) Several hearings have been held with respect <br />to the Slivka Law Suit, dealing with regionalization of the Cleveland Water <br />System, and briefs were submitted.; Law Director filed a motion to dismiss, <br />indicating that the court could not retain jurisdiction in a case like this, <br />where the plaintiff's counsel was asking to assess plaintiffs for attorneys' <br />fees. Received an opinion from Judge George McMonagle; the judge dismissed a <br />number of communities who had paid what they believed to be their assessed <br />share; he did not dismiss North Olmsted and several other communities and has <br />indicated that he would hear these cases on an individual basis. Law Director <br />Gareau had raised the issue with respect to not only jurisdictional questions <br />but contract questions and things of that nature and feels confident that the <br />city should prevail. <br />2) Law Department is currently handling two cases which are below the $50,000 <br />deductible: one is a Rec Center case and the other is a street case where <br />someone claimed an injury due to a defect in Columbia Road. In case council <br />does not realize it, the city is already into the plan of self-insurance. <br />Hopefully, next year, some provisions for funding a line item will be made so <br />the Law Department cannot only negotiate but prepare to litigate such cases. <br />3) The School Guard Case had been appealed to the Board of Unemployment Compen- <br />sation; they have denied the city's request to have the case reviewed. Law <br />Director has received notice that he has thirty days within which to file an <br />appeal in Common Pleas Court. Law Director intends to file an appeal since <br />he cannot comprehend how anybody who takes a job, knows that it is seasonal, <br />and then proceeds to ask for unemployment compensation, particularly when <br />the state code does make provisions for disallowing unemployment compensation <br />for seasonal employees working for the school system. <br />4) Is currently into fact finding with the Police Department and will keep <br />council advised as was discussed in caucus earlier this evening. <br />5) A Civil Service Hearing will be held on Thursday with respect to disciplinary <br />action involving a police officer; meeting is open to the public. <br />~, ~ ~~as~eta~rrn~~tt~w rr ~ ~,`-:~••.a f ire:m <br />
