Council Minutes of 12/16/86 ~ -6- <br />f. Crestmont Corporation, 27000 Lorain Road, request for in- <br />stallation of an 8 foot chainlink fence around entire perimeter. Approved <br />by Planning Commission on November 25th. BZD Committee agreed to reduce <br />part of the fence as follows: Fence shall be 8 feet in height along the <br />northern property line and the portion to the west, facing Dover Center Road, <br />and the rear, or north, of the adjacent property containing the nursing home; <br />the fence shall be 6 feet in height along the entire east side of the <br />property, along the west side, from the northwest corner of the nursing home <br />property to the rear of the new Crestmont building. Mr. Logan noted that he <br />had driven over to inspect this property and noticed the Crestmont Corpora- <br />tion is not complying with the city code regarding the display of banners <br />and pennants; does not the city code have a section prohibiting the display <br />of banners, pennants, etc. Law Director Gareau replied there is a provision, <br />clearly delineated, in the code that says, "attractive banners and things of <br />that nature" are probibited; you just cannot put them up; they are illegal. <br />Mr. Logan moved that council approve the installation of the fence at <br />Crestmont Corporation, as approved by Planning Commision and BZD Committee <br />as stipulated above, contingent upon Crestmont Corporation's full compliance <br />with the city code with respect to banners, pennants and other advertising <br />paraphernalia, second by Mr. Wilamosky. <br />Mr. Rademaker stated that he has the same concerns as Mr. Logan with regard <br />to banners but would not like to establish a precedent that a motion of this <br />nature might set in terms of approving building or development plans in <br />the city contingent upon compliance with a code that is totally unrelated to <br />those building plans.. Enforcement provisions are available, administratively, <br />through the Building Department; does not think council should take the role <br />of an enforcement officer by including that enforcement in approval of a <br />building plan. <br />Mr. Wilamosky stated that council does have an obligation to establish a <br />zoning policy; the administration has the primary responsibility to enforce <br />it. The banners at Crestmont Corporation have been on display for some time; <br />Building Department has either been too busy in other areas or has totally <br />written off enforcement of that section of the code. Hopes the Building <br />Department has not taken "enforcement by complaint" with respect to banners. <br />Feels the display of an American flag by another car dealer, as a means of <br />advertising, appalling. Certain standards and a code of ethics have been <br />established covering the display of the American flag; it is not to be used <br />to sell merchandise. Feels the passage of the motion for the installation of <br />a fence, contingent upon compliance with our existing code, will serve notice <br />on all business people that the city will no longer tolerate a flagrant <br />violation of the zoning code. <br />Roll call on Mr. Logan's motion that council approve the installation of the <br />fence at Crestmont Corporation, as approved by Planning Commission and BZD <br />Committee as stipulated above, contingent upon Crestmont Corporation's full <br />compliance with the city code with respect to banners, pennants and other <br />advertising paraphernalia, second by Mr. Wilamosky: Affirmative vote: Lackey, <br />Logan, McKay, Wilamosky. Negative vote: O'Grady, Rademaker. 4 Aye - 2 Nay - <br />Motion carried. <br />~, 2) BZD Committee also discussed Ordinance No. 86-92, an ordinance amen ing <br />Section 1213.04 of the Zoning Code entitled "Improvements of Parking Areas" <br />of Chapter 1213 entitled "Detailed Requirements", and decided to keep it in <br />committee . <br /> <br />
