Council Minutes of 10/22/86 -5- <br />,,~„~ LEGISLATION (cont'd): <br />Ordinance No. 86-106 introduced by Mayor Petrigac was given its first reading. <br />An ordinance to transfer appropriations for current expenses and other expenditures <br />for the City of North Olmsted for the year ending December 31, 1986. Referred to <br />Finance Committee. <br />Ordinance No. 86-107 introduced by Mayor Petrigac was given its first reading. <br />An ordinance to make appropriations for current expenses and other expenditures <br />for the City of North Olmsted for the year ending December 31, 1986. Referred to <br />Finance Committee. <br />Miscellaneous Business: <br />Mr. McKay reported a phone call he had received from Butternut Ridge Road residents <br />with respect to their application for a building permit. Because the proposed <br />building did not conform, they were sent to the Board of Zoning Appeals for a <br />variance and were turned down. .They want to override the decision of the Board of <br />Zoning Appeals and were referred to Mr. McKay by the Mayor with the statement that <br />this could be done. As long as Mr. McKay has been on Council, he has never ex- <br />perienced an override of the Board of Zoning Appeals; asked the Law Director if <br />Council or anyone else had the authority to override the BZA. Law .Director advised <br />Council cannot override the BZA; only the Common Pleas Court could do so. Mayor <br />stated that she had only told. them that council could override a special permit; <br />council could not override a variance. <br />Mr. Lackey scheduled a Legislative Committee Meeting for Thursday, October 23rd, <br />at 8 o'clock, to discuss the ordinance concerning cable television. <br />Mr. Wilamosky scheduled a Finance Committee Meeting for Tuesday, October 28th, <br />at 7:30 P.M, and requested the Transportation Committee to meet also to discuss <br />the ordinance referred to their joint committees; it will be the first order of <br />business. Will then proceed into a regular Finance Committee Meeting and re- <br />quested the Mayor and her appropriate directors to be in attendance as well as <br />Finance Director Boyle. <br />Mr. McKay scheduled an Environmental Committee Meeting for Thursday, October 30th, <br />at 7:30 P.M., to discuss the legislation concerning the Perry Nuclear Power Plant. <br />Clerk of Council will notify Mr. Paul Hays, CEI representative. <br />Mr. Tallon scheduled a BZD Committee Meeting for Thursday, October 30th, at <br />7:30 P.M., and requested the City Engineer and Building Commissioner to be in <br />attendance. <br />Proceeding with nominations to fill the council-at-large vacancy, Mr. Lackey nominated <br />Mr. Ralph Bohlmann; Mr. Rademaker nominated Mr. Russell Bierman; Mr. Wilamosky <br />nominated Mr. James Logan. Mr. Wilamosky moved that the nominations be closed, <br />unanimously approved. First ballot: Mr. Lackey voted Bohlmann; McKay voted Logan; <br />O'Grady voted Logan; Rademaker voted Bierman; Tallon voted Bohlmann; Wilamosky voted <br />Logan. No majority. Mr. Wilamosky requested a second ballot. Lackey voted <br />Bohlmann; McKay voted Logan; O'Grady voted Logan; Rademaker voted Bierman; Tallon <br />voted Logan; Wilamosky voted Logan. Mr. Logan elected to fill the council-at- large <br />vacancy. Law Director Gareau administered the oath of office to Mr. James Logan. <br />~~** Councilman Logan was recognized by Members of Council and the Administration. <br />~Iflrw <br />The agenda being completed and there being no further business, President Saringer <br />adjourned the council meeting at 9:30 P.M. <br />Florence E.
