Y <br />Special Council Minutes of 8/7/86 -3- <br />Mr. O'Grady, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Moved council have no objection to a D5 liquor permit for E47T, Incorporated, <br />dba Pierogi Garden, 30129 Lorain Road, North Olmsted, Ohio, second by Mr. McKay, <br />unanimously approved. <br />2) Safety Committee met on July 22nd; in addition to committee, Councilman McKay, <br />Councilwoman Saringer and Captain Krynak were in attendance. Committee discussed <br />Ordinance No. 86-60 covering the use of stun guns. Committee recommends approval <br />of Ordinance No. 86-60 as does Captain Krynak and Chief Marsh. <br />3) Committee also discussed the posting of signs in places selling liquor which <br />would warn pregnant women of the danger of drinking alcoholic .beverages. Committee <br />approves and has requested legislation from the Law Department covering this subject, <br />In the absence of President Woerpel, President Pro Tem O'Grady read his report <br />covering the Council-of-the Whole Committee Meeting held on .Thursday, July 24, 2986, <br />which was attended by Councilmen O`Grady, McKay, Tallon and Wilamosky as well as <br />Mayor Petrigac, Finance Director Boyle, Budget and Management Director Cunningham., <br />Assistant Law Director Dubelko and Treatment Plant Supervisor Crider. Mayor Petrigac <br />reviewed the instructions given to her by Judge Sam H. Be11, U. S. District Judge, <br />with respect to the Crumbley Case. Mayor stated that the position of Secretary at <br />the North Olmsted Wastewater Treatment Plant would be offered to Mrs. Crumbley as <br />a compromise solution. Assistant Law Director Dubelko reminded council that the <br />motion to stay had not yet been ruled upon by Judge Be11. Following considerable <br />discussion, Mr. Wilamosky moved, second by Mr. McKay that council not create a new <br />position of Secretary at the Wastewater Treatment Plant;. that there is an existing <br />position of Secretary to the Safety Director, which council is willing to fund at <br />the level of Mrs. Crumbley's salary, and that all respective parties be advised of <br />this decision; motion unanimously approved. Following the vote, it was agreed <br />that Mayor Petrigac had the right to notify Judge Bell that .she disagreed with the <br />motion as passed and Mr. Dubelko mentioned he would convey .all opinions to the <br />judge. Since actions of the committee need to be rat if ied at a regular or special <br />meeting of council, President Woerpel stated that a motion is now in order. to adopt, <br />reject or modify the Committee-of-the-Whole report as read. Mr. Tallon moved <br />council accept the report and motion as approved at the Committee-of-the Whole <br />Meeting, second by Mr. McKay., unanimously approved. <br />Mr. McKay, Chairman Environmental Control Committee as well as Streets and <br />Drainage Committee reported: 1) Streets and Drainage Committee met on July 22nd <br />at 7 o`clock. Present were Councilman O'Grady, Engineer Schaller and Mr. Golden <br />of 23380 Sharon Drive. Committee discussed a Iega1 opinion as to whether the <br />residential property owner in North Olmsted has the same responsibilities for <br />sidewalk repair as the non--residential property owner, under Ordinance No. 1363. <br />It is the legal opinion of the Law Director that Ordinance No. 1363 does not in- <br />clude residents to keep their sidewalks in repair and free from nuisances, therefore <br />the committee has requested legislation requiring residential land owners of <br />abutting properties to keep sidewalks in good repair. <br />2) Mr. Golden, 23380 Sharon Drive requested the city to provide material to repair <br />the drainage ditch in the rear of his property; he will provide the labor even <br />though the city has an easement to maintain this particular ditch. Committee was <br />in agreement with Mr. Golden's request for material to do the job. <br />Mr. Tallon, Chairman Recreation, Public Parks and Buildings Committee reported: <br />1) Recreation Commission met Tuesday with the original architect for the Recreation <br />Complex. He gave the commission his opinions and insights to the building and its <br />problems; feels some of the problems are due to Lack of maintenance and answered <br />all the questions put to him. He feels the building is in fine shape and can be <br />brought back to the once fine structure that it was. It was pointed out that the <br />Complex will never be self-sustaining; the theory that such facilities would pay <br />for themselves and their upkeep has been proven wrong, not only in North Olmsted <br />but in Rocky River, Lakewood and Brooklyn. <br />,e ~~~~, ,: ,_.. ~__~~.,~.~,~,r,.. - ~~..,,~ <br />
