Council Minutes of 5/20/86 _2_ <br />Mr. Wilamosky thanked Mayor Petrigac for her response to his request but noted <br />that the list of Service Department employees was incomplete since it only <br />listed nine employees. He noted that it would be difficult to work with and <br />evaluate exact salary requirements for the entire department based solely on <br />the nine individuals listed. <br />Law Director Gareau reported: 1) City has been named in a law suit dealing with <br />Kenny King's, the structure to be constructed on the west end of the city. The <br />basis of .the suit is that Kenny King's, purchaser of the property, claims to have <br />an easement right to discharge surface water into a drainage ditch running behind <br />property on another street; this property owned by the Mahoney Family. Has ad- <br />vised council, by letter, that the city cannot take an active part in denying <br />permits on the basis of a disputed easement; this is up to the courts to decide. <br />As long as the city is satisf ied that code requirements are met, regarding every- <br />thing else, the city does not have an option to refuse to approve plans and have <br />the permit issued on that basis. A motion for a temporary restraining order has <br />been filed; at this time the court has not acted on this .motion, consequently, <br />the city is not restrained from proceeding; will continue to keep council advised. <br />2) Would like to officially report that the Zurawski Federal Court Case has been <br />dismissed on the basis of the pleadings that were filed by the Law Department <br />asking for summary judgment in that the case was outside of the statute of limita- <br />tions. <br />3) The Zurawski Case which is in the Eighth Appellate District was argued last <br />week; expects a decision on that case within the next two/three months. <br />Finance Director Boyle reported: 1) Arthur Young and Company began their audit <br />on Monday; presume it will be completed and the report issued by the end of June. <br />The only thing that would hold it up is that under the single audit concept, the <br />city has to have, in essence, a sponsor of the federal government. Finance <br />Director is using the EPA out of Chicago, which will add some time since the audit <br />report will have to be forwarded to them and then be approved. This will pre- <br />empt other federal audits for any other federal fundings the city gets. <br />Mr. Lackey, Council's representative to the Landmarks Commission, reported: <br />1) Landmarks Commission is interested in establishing historical districts in the <br />city; have put forth considerable time and effort in laying the groundwork; <br />particularly would like to establish an historical district along Butternut Ridge <br />Road. Current city ordinance, No. 80-51, which establishes the Landmarks Commission, <br />does not include the procedures necessary to establish these districts. Since some <br />revisions are necessary, they. are checking into the possibility of obtaining a CLG <br />which is a Certified Local Government status. If this status is achieved, they are <br />$ien entitled to request grants from both the state and federal government. Upon <br />investigating this possibility, it was found to be too long and too involved; <br />they have now requested the revision of Ordinance No. 80-51 to include historical <br />district provisions regardless of whether they can .comply with the CLG or not. <br />Ordinance No.-86-43, on first reading tonight, requests this revision as well as <br />a change in the terms of membership so the membership would be set up with <br />staggered terms. <br />Mrs. Saringer, Chairman Building, Zoning and Development Committee reported: <br />1) Committee met May 19th with all members present.
