Council Minutes of 5/7/86 -2- <br />6) City of North Olmsted has made arrangements to join the county credit union; <br />council members, full-time and part-time city employees will be eligible to join. <br />7) City of North Olmsted will be joining other communities in a campaign to keep <br />the Cleveland Indian Baseball Team in Cleveland. North Olmsted will cooperate <br />with the Greater Cleveland City and Civic Association by attending the May 23rd <br />baseball game at the stadium. Anyone who would like to attend this game should <br />contact Pat Martin; cost is $9.00. <br />8) May 20th is Senior Citizens' Day; Mayor Petrigac has proclaimed the entire <br />month of May as Senior Citizens' Month; read the proclamation she has issued <br />honoring North Olmsted's Senior Citizens as a valuable asset to the City of <br />North Olmsted. <br />9) Pointed out the new logo which can now be seen on all North Olmsted buses. <br />Law Director Gareau reported.: 1) Assistant Law Director Dubelko and he argued <br />the Cooper Case in the Sixth Circuit on Monday. Law Director had talon three days <br />off last week to review the transcripts of about 800 pages. as well as 250 pages <br />of briefs in various cases. Assistant and Law Director went to Cincinnati on <br />Saturday and spent two days brain-storming the various issues before arguing <br />the case on Monday. Unfortunately, Law Director had only seven minutes to argue <br />his part and Assistant Law Director had only six minutes to-argue his and were <br />only allowed one minute of rebuttal. All the issues could not really be covered <br />but Mr. Gareau thinks the court did point out some very interesting aspects of <br />the case and there has been a lot of development as far as the-issue of <br />res judicata and collateral estoppel; it may well be because the EEOC was inter- <br />ested enough to argue as amicus curiae in this case. They had someone from <br />Washington there to argue the case. Mr. Gareau assumes that if the court should <br />rule in the city's favor, the. issue will probably go to the United States Supreme <br />Court. <br />2) As reported, have received the Burger King decision and have filed a notice <br />of appeal. <br />3) Will argue the Zurawski Case in the Court of Appeals next Tuesday; this deals <br />with the Common Pleas Court Case that was decided against Zurawski and went to the <br />Court of Appeals. <br />4) With respect to the other case pending in Federal District Court with regard <br />to Zurawski, Mr. Gareau has had a request to settle; informed Mr. Zurawski's <br />attorney that the city is not interested in settling because the city has a very <br />strong case in the Eighth District and has the issue of the statute of limita- <br />tions, which is clear cut, in the Federal District Court. Feels the court should <br />make the decisions rather than trying to settle for a monetary amount. <br />At this point in the council meeting, Mrs. Saringer took her place at the council <br />table; time being 8:30 P.M. <br />Finance Director Boyle reported: 1) Rocky River Court has sent the city <br />$10,549.50 as its share of fines levied by the court as well as a report stating <br />they are in the hole for the first quarter of 1986 by $2,610. <br />2) Fairview Park has sent the city a check in the amount of $64,124, which is the <br />final payment on the 1985 sewer bill. First estimated payment of $65,500, for <br />1986,. is due September 1st. <br />3) Audit is underway but the field work has not begun; Finance Department is in <br />discussion with the auditors - doing work papers for them and getting the con- <br />firmations together. Actual field work .will begin on Monday, May 19th. <br /> <br />
