Council Minutes of 1/7/86 <br />-2- <br />-. President Woerpel presented to Council a gavel and gavel block; suitably <br />engraved "President, North Olmsted City Council" with a side plate engraved <br />with the names of Dewey H. Lampert and James D. Boehmer as the recently past <br />presidents of council, and with room for future presidents. <br />Mayor Petrigac reported: 1) Introduced the following new members of her ad- <br />ministration: Director of Budget and Management, Mr. William W. Cunningham; <br />Mrs. Betsy Jack, Director of the Division of.Aging and the Senior Center; <br />Mr. Richard A. Noble, Director of Public Service; Jo Ann Sheridan, Mayor's <br />secretary; Pat Martin, Service Director's secretary; Elaine Cowgill, Engineering <br />Department clerk. <br />2) Police Chief Marsh has advised that Thomas E. Weston has completed his pro- <br />bationary period and is now Lieutenant Weston; Robert Krynak is now Captain <br />and George Ruple is now Sergeant, both passing their probationary period. <br />3) North Olmsted will be receiving the Tree City, USA, Award in 1986, as ad- <br />vised by the Ohio Department of Natural Resources. Their letter praised the <br />City of North Olmsted for its fine tree program and the excellent job being <br />done by David Wendell, City Forester. <br />4) Invited all who could do so to attend the swearing in ceremony of Mrs. Jack, <br />Mr. Cunningham and Mr. Noble on Monday morning at 9 A.M. <br />Law Director Gareau reported: 1) Another law suit has been filed, by Mr. <br />Joseph Corrigan, asking the court to make a determination with respect to his <br />right to maintain his office as Service Director. A hearing was .held in Common <br />Pleas Court on a temporary restraining order and the judge refused to grant <br />such an order thus making it possible for Mayor Petrigac to make her appoint- <br />ment in that position. A brief ing is scheduled for February 1st and Law <br />Director would expect the court to make a decision shortly thereafter. <br />2) A federal case has been filed by Mr. Zurawsky so there is now a case pending <br />in the Court of Appeals in the Eighth Appellate District, a state court, and <br />also a case pending in the Federal District Court, a 1983 action. Law Director <br />has prepared and signed today a motion for summary judgment, asking that the <br />federal case be dismissed because (1) the statute of limitations has run and <br />(2) on the basis called res judicator, meaning the issue has already been <br />adjudicated and (3) collateral estoppel, meaning that Mr. Zurawski is estopped <br />from bringing the action because he had an opportunity to try that action in <br />the state court proceedings. After time has been allowed for filing of their <br />brief, the court will make its decision. <br />3) The insurance company had refused to defend the City of North Olmsted in this <br />case and Law Director plans on filing a separate action against the insurance <br />company for breach of contract; will ask for punitive damages for their failure <br />to fulfill their contractural committment as well as nominal damages. <br />Finance Director Boyle reported: 1) City has filed reports with Moody's In- <br />vestment Service today which should solidify its credit rating for this year <br />in the event it is determined that it is necessary to go out on a short term <br />borrowing; there is not enough time to go on a long term. <br />2) The EEO officer has contacted URS Dalton, construction architect on the Step <br />Three Grant, and they will do whatever is necessary so the City does not <br />jeopardize that grant. <br /> <br /> <br />
