Council Minutes of 10/20/87 -2- <br />8) Mayor has received the Mosquito Surveillance and Control Activities Report <br />for 1987 and has forwarded a copy to the Chairman of the Environmental Control <br />Committee . <br />9) Today, the RTA Board unanimously passed a resolution accepting the results of <br />the Peat, Marwick audit and authorized and directed the Acting RTA Director to <br />proceed with negotiations with the City of North Olmsted in the preparation of a <br />new operating. contract; will be proceeding with that in the next few weeks. <br />10) In the last few days allegations have been made regarding the budget: "cries <br />of wolf" and using "scare tactics" were some of the charges. Mayor would like <br />to put these charges to rest and therefore requests a Council of the Whole <br />Committee Meeting at which time Budget and Management Director Cunningham will <br />present his figures and Councilmen Wilamosky and Bohlmann and Finance Director <br />Boyle can present their figures. If they disagree with Director Cunningham's <br />figures, Mayor would like to know exactly what their figures were based on. <br />Would like to invite the public to attend. <br />11) Noise readings were taken at Fitch and 1480 and will be forwarded to En- <br />vironmental Control Committee. <br />Law Director Gareau reported: 1) Received notification from the Supreme Court <br />this past week that they have refused to accept the appeal of Burger King and <br />consequently the Court of Appeals reversal of the lower court stands. The <br />ordinance enacted by the City of North Olmsted, regarding limitation of hours <br />on drive-thru windows, is in full force and effect. <br />2) In the past week, also received the decision of Judge McAllister in the <br />Nightfall Case; court upheld the city's objection to the use of the non-hard <br />surfaced area being used for parking and issued a permanent injunction enjoin- <br />ing the use of the gravel surface; also enjoined Nightfall with respect to <br />having more than 114 patrons and 50 parking spaces. <br />3) The case involving the lights at Halleen has not come up; pre-trial was <br />held within the past month or so and there was some proposal, presented to <br />council, as far as relocating that dealership. Law Department is still looking <br />at that possibility but has not received any further word on it. Expects to <br />be able to report back to council prior to the next regular council meeting. <br />4) Law Department is presently preparing briefs in the Faughender Case and <br />will move for summary judgment in this case. <br />5) Has scheduled a telephone pre-argument conference with the Sixth Circuit <br />in the Cooper Case which will be held next Tuesday. <br />Finance Director Boyle reported: 1) Discussed the sewer agreement with the <br />Township with Squire, Sanders and Dempsey as far as timing is concerned so that <br />hopefully this .contract can start at a period when Cleveland is normally read- <br />ing meters and will make the billing go a lot smoother. <br />2) Has been discussing an issue that would refinance the Rec Center and figured <br />it would save the city about $4,500 a year; this could be meaningless, coupling <br />the cost with it and what it would do to the city's bond limitations; just wanted <br />council to be informed. Thanked Councilman Lackey for his contribution. and. input. <br />3) Has received some information with respect to State Issue 2 and will make <br />copies for anyone who would like one. This issue allows the state to issue bonds, <br />over a ten year period, and these funds must be earmarked for bridges, street <br />construction and repair in areas where it would promote safety to the population <br />and/or development - in certain areas of the state it is development. Looking <br />at what Cuyahoga County Engineer Neff has put together, it is basically in more <br />residential areas and the top five streets include Clague Road from Lorain to <br />Brookpark. Mr. Neff has determined that this is one of the top five streets and <br />has submitted it in the event that State. Issue 2 passes. The money can be borrowed <br />by the State of Ohio to supplement whatever the City of North Olmsted can pay in <br />and will supplement whatever the county can in redesigning, etc. Payback of these <br />bonds has not really been addressed other than in the development areas where <br /> <br />
