1. <br />Council Minutes of 10/b/87 -b- <br />Mr. Rademaker, Chairman Long Range Planning Committee and Transportation Committee <br />reported; 1) Transportation Committee met on September 24th to discuss Ordinance <br />No. 87-86, an ordinance referring to the construction of a bike path from Columbia <br />Road down Cedar Point Road to Ruple Road. Ordinance calls for the consent of <br />North Olmsted to permit the Cleveland Park Board to construct this bike path within <br />city limits. Service Director Noble advised that there is no financial assistance <br />required from the City of North Olmsted, merely that the Park Board asks that the <br />city maintain this bike path if, and when, it is constructed. This bike path <br />would provide access to the bike paths already established in Metropolitan Park. <br />Since there is no financial obligation, only a request for maintenance, committee <br />has no objection to the ordinance. <br />President Saringer reported that the North Olmsted Transportation Study Team met <br />on October 3rd. An invitation had been extended to all the council-at-large <br />candidates to be in attendance, however, only three of the six candidates were <br />present. They were given a good over-view picture of what the team has done and <br />what the future goals are and what has been accomplished in the past two and a <br />half years. <br />LEGISLATION; <br />Ordinance No. 87-73 introduced by Mayor Petrigac was given its third reading. An <br />ordinance amending Chapter 533 of the Codif ied Ordinances entitled, "Obscenity and <br />Sex Offenses", by adding thereto a new Section No. 533.15 entitled, "Unlawful <br />Exposure by Waiters and Waitresses and Entertainers". Mr, O'Grady moved to <br />table Ordinance No. 87-73 since he had been advised by City Prosecutor Albenze <br />that the ordinance would be declared unconstitutional and further, Law Director <br />Gareau feels that the current ordinances of the City of North Olmsted are very <br />adequate to cover this matter, second by Mr. Lackey. Roll call on motion to <br />table Ordinance No. 87-73: Affirmative vote: Bohlmann, Lackey, O'Grady, Rademaker, <br />Tallon, Wilamosky. Negative vote: McKay. 6 Aye - 1 Nay - Motion carried. Ordin- <br />ance No. 77-73 tabled. <br />Resolution No. 87-84 introduced by Mr. Tallon was given its third reading. A <br />resolution accepting for recording purposes only the Clarence and Lucy Spradling <br />Subdivision and Assembly Plat in the City of North Olmsted. Mr. Tallon moved for <br />adoption, second by Mr. Bohlmann, unanimously approved. Resolution No. 87-84 <br />adopted. <br />Ordinance No. 87-85 introduced by Mr. Bohlmann was given its third reading. An <br />ordinance adopting a new and revised Chapter 13b7 of the Codified Ordinances en- <br />titled, "Regulation of Dish--Type Satellite Signal-Receiving Earth Stations", as <br />amended. Mr. Bohlmann moved for adoption, second by Mr. Tallon, unanimously <br />approved. Ordinance No. 87-85 adopted. <br />Ordinance No. 87-86 introduced by Mayor Petrigac was given its third reading. An <br />ordinance to construct an eight foot wide asphalt bikeway from Columbia Road <br />(SR 252) to Ruple Road in North Olmsted, Brook Park and the Cleveland Metropolitan <br />Park District, a distance of 0.83 miles more or less. Mr. Rademaker moved for <br />adoption, second by Mr. McKay, unanimously approved. Ordinance No. 87-86 adopted. <br />Ordinance No. 87-94 introduced by Mr, Wilamosky was given its second reading. An <br />ordinance to establish within the special revenue fund group a "Street Rehabili- <br />tation Fund - Income Tax" and a "Permanent Improvement Fund - Income Tax" of the <br />City of North Olmsted for portions of the City's Municipal Income Tax Revenues, <br />and declaring an emergency. <br /> <br />
