Council Minutes of 2/3/87 -2- <br />8) Has requested the Law Department to prepare legislation for a Charter amend- <br />ment eliminating the words "nor shall he hold any other public office or public <br />employment" under the. section covering the. Mayor. North Olmsted is one of the <br />few cities to have this prohibition;- it may be to the city's advantage, if <br />positions open up on the RTA Board, to have this prohibition removed. <br />9) Has requested Council to confirm the appointment of Dave Spoerke to the <br />Board of Building Code of Appeals; Marie Case to be re-appointed to the Architectural <br />Review Board;P_a.t Strange to be re-appointed to the Human Resources Advisory Board <br />and Brian Zergott to be appointed to the Architectural Review Board. <br />10) Has received letters from North C1lmsted High School, from Bay Village, the <br />YMCA, and others, with respect to the possible elimination of the YDP Counsellor. <br />11) Has received the Five Year Study Plan from the Citizens' Ad Hoc Advisory <br />Committee which will be meeting this week to refine their conclusions. Would like <br />to meet with council the first of next week to go over the plan. Does not feel <br />there is time to consider any type of ballot issue to be placed on the ballot by <br />May. <br />Mr. Wilamosky asked, in light of the. letters received with respect to the YDP <br />Counsellor, has Mayor Petrigac changed her position with respect to continuing <br />with the cuts in YDP. Mayor responded that she personally feels this is an asset <br />to the city; if there is a way to fund that program beyond July, would like to <br />have that done, however, she has been unable to find the monies for this program <br />in her appropriations. If council can find the money, it would be a priority <br />that she would like. <br />Mr. Lackey noted that with respect to the Mayor's request for legislation to <br />change the charter to allow the Mayor of North Olmsted to accept appointments <br />to other boards, the issue was brought up by Mayor Swietyniowski at the 1985 <br />Charter Review Commission. Commission was in favor of it at the time but did <br />not act on it because of more important priorities. <br />Law Director Gareau reported: 1) As discussed at the last council meeting, he <br />did file the law suit against Nightfall; a temporary restraining order hearing was <br />held; city agreed to meet and try to work out same of the existing differences. <br />A preliminary injunction hearing is set for tomorrow. Nightfall had agreed to come <br />before the Planning Commission and they did so. Members of the commission suggested <br />the meeting to iron out some of the problems and, in fact, such a meeting was held <br />Last night but nothing was worked out. Positions have been solidified, so the city <br />will go forward tomorrow morning, in court, on the preliminary injunction. Will <br />be keeping council advised. <br />2) As indicated, had submitted a brief in the Citrus Trust Case; the case has been <br />continued. <br />3) Appeared for the Fire Department before a "fact finder" with respect to wage <br />negotiations; this has finally been concluded. <br />4) Met on site with alighting expert at Halleen; he has presented some preliminary <br />findings relative to the lights; he intends to visit the site again Thursday even- <br />ing, when the establishment is open, to examine the light pollution. He has already <br />indicated there is some substantial problem with the lighting and will be making <br />recommendations. Will present the findings to Halleen;. if they refuse to cooperate <br />or neglect to cooperate, city will go back into court on the preliminary injunction <br />z~ on this case. <br />,~ <br />Mr. Rademaker asked what Nightfall's objection was to complying with the city with <br />respect to the resident's complaints of code violations. Mr. Gareau stated that <br />basically they complain about the cost; they have the impression that they are <br />"grandfathered" and that they do not have to do what the city is asking them to do. <br /> <br />
