Council Minutes o~ 2/3/87 <br />-3- <br />In response to Mr. Logan's question, Mr. Gareau said that he had the impression <br />that the Nightfall owners were told that they did not have to go before the <br />Planning Commission. Did not want to go into details since there is pending <br />litigation. They must meet city requirements; they will either comply or the <br />city will close them down. There is a problem with respect to interpreting the <br />code and coming to the Law Department if there is a problem with interpretation. <br />Is working with the Mayor to resolve this problem right now. <br />Finance Director Boyle reported: 1) With respect to the Mayor's comments regarding <br />Fogg, they came to the CIC about two years ago about increasing their building size. <br />CIC had approved the interest would be non-taxable. Because of the market, they did <br />not want to sell at that point. Laws have changed considerably on that type of bond; <br />there is a "sunset" so that a company cannot hold that until the market is real <br />good. The market did not change; they ended up doing it on their own. City ex- <br />tended it last year about this time to give them that opportunity because it was <br />worthwhile. They could find conventional financing, mare to their liking, and did <br />take that. The "sunset" came about towards the end of 1986 and city could not ex- <br />tend any more. That is not a loss; the purpose for a CIC is to promote additional <br />employment through development and this was accomplished. <br />2) In 1983/84 had reported on the Social Security Act which actually made city bonds <br />and notes taxable to a certain extent; worse, it made it taxable to senior citizens. <br />A case is now pending before the Supreme. Court, which, depending upon the outcome, <br />could decrease the cost for all local government and have a good affect on the City <br />of North Olmsted. <br />3) House Bill 721 allows firemen and policemen to buy back their service credits <br />through payroll deductions. The Pension Boards of fire and police have been dragging <br />their feet a little bit, intentionally, because there are approximately 500 communi- <br />ties this applies to and they are trying to get their paperwork in order. The City <br />of North Olmsted will be offering this to our Police and Fire Departments within the <br />next month or so. <br />4) Received a bill from Rocky River Court; city costs for the last year were <br />$22,359.57, which is 34.67 of the court's $64,000+ cost. The 34.6 represents not <br />only the city's share but also it's share of cases before that court. <br />5) Workmens' Compensation Bureau has informed the city that its cost will be $2.81 <br />per hundred dollars of payroll. This is an increase from $1.74 per hundred dollars <br />last year. In the last few years, city has been below the $2.00 mark; it is now <br />just about a.t the $3.00 mark. <br />6) Reported on the W2 forms at the last meeting; Secretary of the Treasury does not <br />like the form either but the Internal Revenue Service overruled him last week and <br />is going to stick with it. Will be sending a staff member to a meeting next week <br />to learn more about the new W4. These forms are availabe at the Finance Office <br />and will be included in the next payroll or two. If you do not rely on this as <br />your sole source of income, you are subject to filing it by October. There is a <br />toll-free number to call if you have any questions to ask. If you can't get <br />through, call Finance Department and an effort will be made to assist you. <br />Mr. Logan, Chairman Intra-Governmental Relations and Legislative Committee reported: <br />1) Moved council approve the following mayoral appointments: Pat Strange - Human <br />Resources Advisory Board; Marie Case - reappointment to the Architectural Review <br />Board; David Spoerke - Board of Building Code of Appeals; Brian Zergott - Archi- <br />tectural Review Board, second by Mr. Rademaker, unanimously approved. <br />°'" <br />,~ ~ ' <br />
