VACATION OF REMNANTS AND/OR LIMITATION OF ACCESS The vacation of right of way remnants along existing highways that are no longer necessary or needed for the construction and/or maintenance of the highway, or the modification of limitation of access restrictions, ~s u_sually at the request of the abutting owner or holder of the underlying fee. Since such vacations rarely bestow a benefit upon the highway but almost invariably enhance the value of the abutting property, the Department may request the owner to bear all or a portion of the administrative .costs (advertising, appraisal, etc.). Depending upon the circumstances that surrounded the State's original acquisition, the owner may be requested to pay the State an equitable amount for its interest in the property. Vacations are not mandatory and the Department can only re nest the abutting owner or owners of the underlying fee to pay for various costs 6 ~~
