The Bureau of Right of Way Engineering shall, 'n <br />n, notify the Bureau of Utilities and Properties of the recordati <br />olume, page and date) of the vacation. <br />VACATION OF REMNANTS AND/OR LIMITATION OF ACCESS <br />The vacation of right of way remnants along existing highways that <br />are no longer necessary or needed for the construction and/or maintenance <br />of the highway, or the modification of limitation of access restrictions, <br />~s u_sually at the request of the abutting owner or holder of the <br />underlying fee. Since such vacations rarely bestow a benefit upon the <br />highway but almost invariably enhance the value of the abutting property, <br />the Department may request the owner to bear all or a portion of the <br />administrative .costs (advertising, appraisal, etc.). Depending upon the <br />circumstances that surrounded the State's original acquisition, the owner <br />may be requested to pay the State an equitable amount for its interest in <br />the property. <br />Vacations are not mandatory and the Department can only re nest the <br />abutting owner or owners of the underlying fee to pay for various costs <br />6 <br />~~ <br />
