If the requesting owner and the <br />Department fail to raa~h a mutual aQr~ent on the terra and conditions of <br />the contemplated vacation, intiuding any cos s which the requesting owner <br />•ay be asi~ed to bear, neither. the reggesting offer ~r the QepartaNent is <br />under any legal obligation to formali2e or conclude vacation proceedings. <br />Thus, the va€ation of any recants alor~ higtwr~y right of way or <br />~, math f i cati on of 1 imi t~tioh of access i s to be approached with caution; yet <br />there are many sit~te~c were s#mple morality requires that the request <br />for vacation be revs- To safeguard the State's interest, certain <br />steps are to be foil-awed. <br />p a. Request for Vacation or Modification <br />The DDQ receiving the request for vacation or modification secures a <br />statement in writing frow the requesting owner containing: <br />1) The location of the property. <br />(; 2) An identification of the property to be vacated or the iimita- <br />tion of access to be modified. <br />e 3) The amount paid him or his predecessor in title for the right of <br />way (if known). <br />S 4) The amount, if any, he will pay or reimburse the State if <br />vacation orieodification is accomplished. <br />5) His agreement to pay administrative costs and payment to other <br />owners having a legal claim, if any. (Waivers from other owners <br />may be s~stituted for this.) <br />b. Processing Request in District Office. <br />"' The DDD may approve or deny the request. When Me approves the <br />request he has a plat prepared showing the following: <br /> 1) The area proposed to be vacated and/or limitation of access to <br /> be modified. <br />~" 2) The remaining right of way and/or limitation of access. <br />Q 3) The name and address of all affected fee owners. <br /> He t hen addresses a written request to the Assistant Deputy Director, <br /> Real Esta te Administration stating as follows: <br />r 1) His recomeendation on the proposed vacation or modification of <br /> limitation of access. <br /> 2) All known advantages or disadvantages to the State. <br />e <br />S 3) All known advantages or disadvantages to abutting owners. <br />t <br />b <br /> 4) o <br />The original cost to the Department of the right of way e <br /> vacated or limitation of access to be modified. <br />" 5) The amount the owner. is willing to pay or reimburse the State if <br /> the proceedings are completed. <br />7 <br />~~ <br />
