Council Minutes of 12/6/88 -2- <br />6) Recommends the reappointment of Art Boessneck to the Department of Human <br />Resources Advisory Board; this is a five year appointment which expires December <br />31, 1993. Would like council's confirmation on the reappointment of Marie Case <br />and Brian Zergott to the Architectural Review Board as well as the reappointment <br />of Bob Grace to the Board of Zoning Appeals. <br />7) Thanked Ken Campbell and Tom O'Grady for their help with the newspaper re- <br />cycling this weekend. The profits for this month and next month's collection <br />will pay for the inscriptions of "Supple" and "Bahas" on the memorial markers <br />at the park. If you would like to help the weekend of January 7th and 8th, <br />please call Mayor's secretary, Patti Florkowski to be scheduled. <br />8} Christmas Tree Lighting Ceremony will be held this Sunday at 6 P.M.; a Santa <br />Skate will take place at the Rec Center this same date and time. <br />9) Has sent letters to Cleveland and North Olmsted area residents asking for <br />assistance in holding a fundraiser for the Recreation Complex; has received <br />replies and will be holding a meeting the first part of January; would hope <br />that council would participate. <br />10) This morning, joined Amy Watts and Frank Sherkow in an address at Cleveland <br />State University covering common development issues confronting the public and <br />private sectors in the greater Cleveland area. <br />11) Reported the theft of the American and POW/MIA Flags from in front of Town <br />Hall. <br />12) Cook Road water line pre-bid meeting was held yesterday with six prospective <br />bidders; bid opening will be December 14th with construction to begin in .March <br />at the west end. <br />13) Expressed appreciation to Troop 52 for the third annual decoration of the <br />Council Chamber christmas tree. <br />14) Is negotiating with a private company to reinstate the Leaf Pickup Program; <br />will be meeting the first part of 1989; if such a plan is affordable, it will <br />be added to the appropriations in 1989. <br />Presiding Officer O'Grady asked if the Mayor would coordinate the public hearing <br />with respect to Clague Road; Mayor stated that she would do so. <br />Law Director Gareau reported:. 1) Has been notified by the lighting expert who <br />was hired in the Halleen Case that the lights have been appropriately fixed; <br />all the shields have been appropriately placed on the lights; the glare has <br />now been eliminated. <br />2) With respect to the Liza Jennings Case, the Court of Appeals ruled in favor <br />of Liza Jennings and ordered the City of North Olmsted to issue permits with <br />a tap-in fee of some $69,000 rather than the increased amount the city claimed <br />was due under its ordinances. Because the original jurisdiction was in the <br />Court of Appeals, city has the right to appeal to the Supreme Court and Law <br />Department is in the process of preparing such an appeal. <br />3) Pre-trial was held today with respect to the Sunset Memorial Case; Judge set <br />February 7th as a trial date on this case. <br />4) Date had been scheduled for the Brian Case, dealing with the building of a <br />barn on property behind the drug store complex at Stearns and Lorain Roads without <br />a permit; case has been continued until March 9th, 1989. <br />5) Has been meeting with various law directors with respect to .the EPA assessing <br />cities for contributing to the landfill in Garfield Heights. Discussions covered <br />the possibility of resolving this dispute; EPA has indicated they intend to pursue <br />this cause of action until it is settled. Is not at liberty to indicate the terms <br />of the proposed settlement; council should, in open meeting, vote to go into <br />executive session to deal with the proposed settlement. Would suggest waiting <br />until the next council meeting since there is another meeting on this tomorrow <br />to discuss what final proposals would be appropriate to settle the case. <br />6) Met with three members of council regarding the possibility of using tax <br />abatement to attract prime office tenants to the City. Mr. Wilamosky will discuss <br />this further in his report and perhaps schedule an open meeting for discussion. <br /> <br />
