Council Minutes of 3/1/88 -3- <br />b. Romp's Dairy Queen, 24579 Lorain Road, revision to exterior of <br />building from plan originally approved by Planning. Commission on December 9, 1986. <br />A section of the front, which was to be all glass, was changed to brick in order <br />to accommodate some coolers. BZD Committee concurs with Planning Commission's <br />approval of the change, therefore Mr. Tallon moved Council approve the Dairy <br />Queen revision as stated above, second by Mrs. Bahas. Roll call on motion: Affirm- <br />ative vote: Bahas, Boehmer, O'Grady, Tallon, Wilamosky. Negative vote: McKay. <br />5 Aye - 1 Nay - Motion carried. <br />c. Mongello Office Building, 3683 Clague Road, proposal to con- <br />struct small addition to rear of building. BZD Committee concurs with Planning <br />Commission's approval of addition, therefore Mr. Tallon moved Council approve <br />the Mongello Office Building addition as stated above, second by Mr. O'Grady, <br />unanimously approved. <br />2) Committee discussed Ordinance No. 88-30, proposal to grant an extinguishment and <br />release of a utility easement granted to the City and recorded in Volume 238, Page 65, <br />in Cuyahoga County Plat Records and to further accept a new easement in place thereof <br />for the installation and maintenance of sewers for the purpose of supplying sewer <br />service to Hastings Drive properties. Proposal has been approved by Engineering <br />Department; BZD Committee has no objection. <br />3) Committee discussed Ordinance No. 88-29, granting the extinguishment and release <br />of a sewer easement granted to the Ciby and recorded in Volume 11663, Page 681, <br />of Cuyahoga County Plat Records. Proposal has been approved by Engineering Department: <br />BZD Committee has no objection. <br />4) Committee discussed the Bradley Oaks Subdivision Improvement Plan. Engineering <br />Department had some questions with the plans; developer answered these questions <br />and resubmitted plans to Engineering Department who approved revised proposal. <br />BZD Committee also approved the plans by a 2/1 split vote. Mr. Tallon moved Council <br />approve the improvement plot resubmitted by Bradley Oaks Subdivision, second by <br />Mr. O'Grady. Roll call on motion: Affirmative vote: Boehmer, O'Grady, Tallon. <br />Negative vote: Bahas, McKay, Wilamosky. 3 Aye - 3 Nay - Motion defeated. Law <br />Director asked if the Improvement Plans were approved by Engineering Department and <br />when advised that they had,. cautioned Council on the "no" votes; since the re- <br />vised plans have been approved by the Engineering Department and comply with the <br />ordinances of the City, the council does not have any authority to vote "no"; <br />this is not a discretionary issue. Mr. Wilamosky moved to place the Bradley Oaks <br />Subdivision proposal back into the BZD Committee to a date certain of March 15, <br />1988, second by Mrs. Bahas. Roll call on motion: Affirmative vote: Bahas, Boehmer, <br />McKay, Wilamosky. .Negative vote: O'Grady, Tallon. 4 Aye - 2 Nay - Motion carried. <br />Bradley Oaks Subdivision proposal returned to BZD Committee to be reconsidered at a <br />date certain of March 15, 1988. <br />Letters and Communications: <br />Acting Clerk Spencer reported receipt of a letter from the Office of the Governor <br />acknowledging receipt of the resolution passed by North Olmsted in support of <br />legislation to restrict the use of high phosphate detergents. <br />Audience participation. <br />Cliff Crabs, 25575 Butternut Ridge Road, discussed his plat of lot split and <br />assembly and easement vacation; is he free to go ahead and sell his property <br />based on the realignment of the lines. Law Director advised that he would assume <br />that once the plat was recorded there would be no prohibition; it generally takes <br />two or three weeks for the plat to be recorded; hopefully, the extinguishment of <br />the easement will be taken care of in six weeks. <br />
