- ~~ <br />' ~ Council Minutes of 7/5/89 -3- <br />Law Director Gareau advised that the legislation calls for the Mayor to accept <br />proposals; it does not provide for hiring anybody; the ordinance does not need <br />to be amended. Council has indicated it would look favorably upon a proposal <br />that would deal with other subjects but the primary thrust was for the road and <br />traffic signalization. If someone wants to put an additional addendum on a <br />proposal, in saying "by the way, I could also look at this", is sure there would. <br />be no objection. <br />Law Director Gareau reported: 1) With respect to the case where a city snow plow <br />collided with a van at Dover Center Road, the case was being prepared for trial <br />but because the rules of court provide that an expert's report must be made to <br />the city within a specified period of time, and the other side did not have that <br />report, they voluntarily dismissed the case and will re-f ile. <br />2) Within the last several weeks, city has been sued by a minor, through his <br />parents, for injury on a sewer grate in the David Drive area. Law Department is <br />currently working on a motion to dismiss a portion of this as well as preparing <br />an answer for the balance. <br />3) Is also working on a motion to dismiss the entire Dingess Case which is now in <br />federal court. <br />4) About a year or so ago, a bus driver was discharged because the Civil Service <br />Commission found he was rude to some passengers and had missed a number of days. <br />That case was found favorably for the city at the Civil Service level, the <br />Common Pleas level. It was appealed to the Court of Appeals. The trial judge <br />failed to make findings of facts and conclusions of law which were requested by <br />the appellant and the case was dismissed out of the Court of Appeals. This past <br />week, Law Director Gareau has prepared findings of facts and conclusions of law, <br />requesting the judge sign those so that the time for appeal can start to run. <br />Finance Director Boyle reported: 1) Water rates will be going up as per the next <br />billing. Cleveland has had their annual audit and has set the charge for billings <br />at $3.20, which is a 12~ increase over last year. <br />2) Finance Director has just received reimbursement from the Regional Income Tax <br />Agency of over $30,000, including interest .of about $4,000, for a total of $42,000. <br />Mr. Boehmer, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Moved council have no objection to the issuance of a D5A permit to Great <br />Northern Honors Company, a limited partnership, dba Pierre Radisson Inn, 25070 <br />Country Club Boulevard, North Olmsted, second by Mrs. Bahas, unanimously approved. <br />2) Moved council have no objection to the transfer of a D2, D2X liquor permit from <br />York Steak House Systems, Incorporated, 4900 Great Northern Boulevard, Unit 53, <br />to York Steak House Systems, Incorporated and Dragon Gourmet, Incorporated, dba <br />Dragon Gourmet, 26324 Lorain Road, North Olmsted, second by Mrs. Bahas, unanimously <br />approved. <br />3) Rescue squad is back in service at Station No. Two after being repaired. <br />Mrs. Bahas, Chairman Long Range Planning Committee reported: 1) On June 26th, the <br />Long Range Planning Committee met with Council-as-a-Whole to discuss the joint <br />proposal of Horizons/Kiwanis for the lease with the city on the home located at <br />26272 Butternut Ridge Road. This house was purchased with funds from Community <br />Development Block Grant and was to be used for programs for the handicapped. <br />Several concerns were discussed at the meeting and they are reflected in Ordin- <br />ance No. 89-64 which is on the agenda this evening. The areas of concern have <br />been covered in the legislation as well as in the lease. Committee has no objection <br />to the legislation and recommends adoption. <br />~: .i <br />
