Council Minutes of 4/4/89 <br />-4- <br />b. Sparky Plaza, north side of Brookpark Road Extension, <br />adjacent to Hill's Department Store, proposal to construct a retail building. <br />Variance granted by BZA on February 1st; plans approved by ARB on March 22nd, <br />with recommendations; approved by Planning Commission on March 28th. BZD <br />Committee was a little upset because the property was rezoned only a year ago <br />in the belief that the developer was going to develop it within the guidelines <br />of the city's code and without any variances. This did not come about and a <br />variance was granted. The developers were very cooperative and after much dis- <br />cussion the committee came up with some provisions to protect the neighbors, <br />as listed herein: <br />1) Installation of a 3 foot board-on-board fence on the <br />west end of the property line, approximately 8 inches <br />above finished grade of the parking area and with the row <br />of trees as shown on the present plan included on the <br />developer's side of said fence. <br />2. Electrical feeders will be underground from the CEI pole <br />to the transformer on the northwest corner of the building. <br />3. New. light and pole on the southwest corner of the property <br />will be electrically fed underground and will replace the light <br />pointing west on the front of the building. <br />4. The mansard will continue around the entire west side of <br />the building. <br />5. The rooftop air-handling units will be screened from the <br />rear, or north. <br />Mr. McKay stated that he felt some very exceptional variances were granted on <br />this particular development. He feels the Board of Zoning Appeals concluded <br />that it was council's desire to develop the property and that is why they granted <br />such cutting variances. In the future, possibly council should be very aware <br />of the size of the property and how we are rezoning - to make sure a building <br />can be erected without having variances as severe as the ones pertaining to this <br />particular property. Mr. Tallon responded that the builder chose to try for a <br />variance to put up a larger building; the BZA concurred and if a variance is <br />granted, council cannot do anything. about it. This was the builder's right and <br />the right of the BZA to either grant or deny the variance; in this case, they <br />chose to grant it. Mr. Ta11on pointed out that because of the controversy in- <br />volved and the number of changes to the plan, the developer was very cooperative <br />in working with the BZD Committee. Mr. Tallon moved council approve the Sparky <br />Plaza, with all the recommendations stated above, second by Mr. W ilamosky, unani- <br />mously approved. <br />Mr. Wilamosky, Chairman Finance Committee reported: l) Finance Committee met on <br />April 3rd, with all members in attendance, as well as the Mayor, Fire Chief, <br />Finance Director and Councilmen McKay and Boehmer. Equipment needs of the Fire <br />Department were discussed with Chief Van Kuren. The administration had in- <br />cluded within the appropriations, the sum of about $22,000 for equipment purchase, <br />which would purchase a minimal number of air packs, turn-out suits, etc. <br />Committee withdrew the amount; there would not be sufficient monies in the line <br />item to meet the projected purchase goals or to meet the 1992 deadline for up- <br />dating the equipment. Another communication was received indicating the need <br />for another $8,000 in that line item for equipment such as foam, tape, flash- <br />lights and batteries, etc. Committee discussed the possibility of the utiliza- <br />tion of notes to cover the cost of a new rescue squad; the purchase of turn-out <br />equipment such as jackets, pants, helmets and protective gear; air tanks with <br />additional bottles; personal saf ety devices which go off automatically and <br />signal when a firefighter is in trouble.
