Council Minutes of 11/7/90 <br />Law Director Gareau reported: 1) The opposition in the case of Cater vs. <br />the City of North Olmsted has filed a motion for acceleration on the <br />docket. We have filed a brief in opposition to that motion indicating <br />that the facts do not necessitate advancing this case on the docket. <br />This is in the Court of Appeals. Mr. Gareau is currently wgrking on a <br />brief acid a motion to have the matter disposed of on summary J't. <br />2) Yesterday, the Faughender case was argued in the Sixth Circuit <br />Federal. Court of Appeals in Cincinnati. <br />3) The Un~nployment Bureau Appeals Division has refused to declare our <br />school guards seasonal employees. An appeal will be filed because of a <br />Toledo Court of Appeals decision which supports our position. <br />4) We have been served with an amended complaint in Hertz vs. the City of <br />North Olmsted (snow plow case) on behalf of the spcwse of the injured <br />party. The complaint asks for moray damages for loss of services. <br />Finance Director Burns reported: 1) The City of Fairview has given verbal <br />OK for the past capital contract for Cheir sewer agreement. Under the <br />terms of this agreement, we will receive $50,800 in 1991; $75,800 in <br />1992. <br />2) On October 30, we closed the $1.2 million sewer transmission line <br />rehabilitation notes; interest rate was 6.31X. <br />3) Our first collections from the Ohio inheritance tax received in <br />October was $131,626. <br />4) The first two months collections of the hotel/motel tax were: August <br />(including the short period in July) - $13,471; September - $11,696. <br />These funds are restricted to Safety Department equipment. <br />5) At our budget hearing on October 29, we learned that the City's <br />portion of the real estate taxes will be 13.2 mills as opposed to 14.0 <br />mills last year. This savings is primarily a result of the Sewer Bond <br />Fund, which had acctanulated an excess balance, in addition to the <br />interest earnings that we have had in the past and in addition to the <br />settlement with Fairview Park oci its past capital. <br />Mr. McKay, Chairman of the Environmental Control Committee reported: <br />1) The Environmental Committee met on Monday, October 29, to discuses <br />Resolution No. 90-137, which provides for the Service Director to go out <br />on bids for solid waste collection. In attendance were: Council <br />President Boehmer; Council M~nbers Nashar, Beringer and Bahas; Service <br />Director Bohlmann; Admire, and personnel Director Wilamosky; guests <br />Margaret McKay, Christine Walters, and John Fairfield. Our current <br />contract with BFI will expire on December 31, 1990. The current cost of <br />$750,000 will probably increase to $1,000,000 or more for the coming <br />year. We hope to get bids from several ccxnpanies, including BFI. We <br />will be exploring the various methods of recycling and what each company <br />plans to do for the City in the area of recycling. The Committee <br />recommends passage of Ordinance 90-137. <br />Mr. Tallon moved to appoint Barbara Seman to full-time Acting Clerk of <br />Council in the absence of Clerk Florence Campbell and until her return; <br /><:~ second by Mrs. Bahas; passed unanimously. <br />2 <br /> <br />
