Public Hearing Minutes of 9/18/90 <br />present Council with a new proposal for Mixed Use restrictions. He <br />stated that Planning Commission wanted to make sure there would be no <br />possible way that retail stores would be introduced in this area. <br />Mr. McKay mentioned that although deed restrictions might limit retail, <br />deed restrictions can be changed by mutual consent of the parties. <br />Law Director Gareau cited a savings clause in the Zoning Code that <br />allows nonconforming parcels to be zoned for specific uses even if they <br />don't meet the area requirements. In his opinion, this tract of land can <br />be rezoned because it is adjacent to a larger parcel of land zoned for <br />Mixed Use arrl it is owned by the same person. <br />Mr. Skoulis maintained the Zoning Code does not allow such a rezoning. <br />President BoeYmier adjourned the Public Hearing at 7:30 p.m. <br />~~ ~~ ~. ~- <br />rbara L.
