Council mutes of 8/21/90 <br />Association of the United States and Canada." Two of the members of <br />that Finance Department are still employed by the City: Linda Spencer <br />and Mary Kay Lilly. They did a good job and should be commended. <br />Law Director Gareau reported: 1) Upon my request, the Ohio Municipal <br />Attorneys' Association has filed an amicus curiae brief, a friend of <br />the court brief, in the Faughender case. The issue is no longer <br />simply between the City of North Olmsted and one person; it is now an <br />issue that deals with the entire State of Ohio. <br />2) We have filed a lawsuit against the National Union .Insurance Co. <br />aryl have asked pinitive damages as well in the amount of $4,000. <br />This is the insurance company that refused to represent us in the <br />Dingess case. <br />3) In regard to the Eliza Jennings case, the Supreme Court had <br />determined that they owed us a $106,000 tap-in fee. After <br />unsuccessful attempts to collect, we have filed a lawsuit and are also <br />asking for pre-judgment interest. <br />4) We have received the lawsuit regarding the Georgalis rezoning. <br />This will be discussed in executive session. <br />5) I have received a letter from an attorney asking me to file a <br />taxpayer's action on behalf of the citizens of North Olmsted regarding <br />the discharge of Mr. Stroh from the Civil Service Commission. This <br />will be discussed in executive session. <br />6) For the past nine years, we have had an appeal pending in the <br />Common Pleas Court regarding an adverse decision on an arbitration <br />award to AFCSME in the amount of $15,000. The judge, on my <br />recanmendation, dismissed it; however, AFCSME asked him to set the <br />dismissal aside. This was done without ~tification to us. After the <br />reinstatement,-the judge ruled in favor of AFCSME. We must now decide <br />haw to appeal. This will also be discussed in e~cecutive session. <br />7) We have received a reply brief in Smith versus the City of North <br />Olmsted, which is the case of the firefighter asking for vacation time <br />for time served in the National Guard. The case is briefed, and we <br />axe waiting for the Court of Appeals to determine our legal position. <br />Mr. Nashar moved to go into executive session after the council <br />meeting; second by Mr. O'Grady. Passed unanimously. <br />Finance Director Burns reported: 1) The annual information statement <br />has been finalized and will be sent to M©ody's for our bond rating. <br />The industrial revern~e bonds will be sold on September 6 and will be <br />issued on October 1. <br />2) Mr. Malone, Fairview Park Finance Director, and myself have been <br />discussing and finalizing the dollar amounts for the Fairview Park <br />capital improvement agreement from the sewer system. <br />3) The 1988 audit was campleted and approved by the State Auditor's <br />office. <br />4) The 1989 RTA audit has been completed. The findings of the audit <br />shwa that North Olmsted owes RTA $22,000. This has been paid. The <br />bulk of .this money, $19,000, was the result of the differential for <br />diesel fuel costs to the City of North Olmsted and that which RTA <br />pays. <br />3 <br /> <br />
