<br />MINUTES OF TfB~; PUBLIC HEARING <br />DECEMBER 3, 1991 <br />7:00 P.M. <br />Present: Council President Boehmer, Council Members Leonard, Lind, McKay, <br />Nashar, Saringer. Mrs. Bahas arrived at 7:32 p.m.; Mr. Tallon <br />arrived at 7:37 p.m. <br />Also Present: Clerk of Council Barbara Seman. Law Director Gareau arrived at <br />7:35 p.m. <br />Council President Boetarier called the Public Hearing to order at 7:01 p.m. and <br />announced that the hearing concerned Ordinance 91-132, an ordinance providing for <br />the amendment of the Zone Map of the City of North Olmsted, which Zone Map is <br />part of the Zoning Code of the City of North Olmsted, by changing the premises <br />hereinafter described from Single Residence A District to Mixed Use District A. <br />Audience Partici tion <br />Ei~ean Sch er, ~+ -Clareshire, 2-H, reminded Council that the residents ha.d <br />been fighting this rezoning for five years. Five years ago, 700 names were <br />presented on petitions asking Council to keep the residential zoning of this <br />land; last year 1,200 names were presented on a similar petition. A number of <br />residents have diligently fought to keep the zoning residential; however, the <br />City has advised that this case could not be won in court. The residents have <br />accepted this fact and have erxleavored to negotiate the best deal passible with <br />Mr. Biskind. One important deed restriction that was agreed to is the height <br />limitation of four (4) stories on all buildings constructed an this land. In <br />addition, the residents requested an additional 50 feet of setback on the <br />Columbia Road area and more landscaping. Mr. Biskind did not think it was <br />possible to do this; however, he did offer a small piece of property across the <br />street to be used as a park. Mrs. Schuler said the property owners wvv3.d like <br />the area to stay residential, but are resigned to the fact that the land will be <br />rezoned. They fought a hard battle and did not back down; they feel they have <br />been forced to accept the rezoning. <br />Angelo Skoulis, 24732 Mitchell Drive, also had worked to oppose the rezoning. He <br />said that most of the concerns regarding height of the buildings and setbacks had <br />been addressed by Mr. Biskind and were no longer a concern. however, the main <br />reason the citizens had opposed the rezoning was the feeling that there was too <br />much commercial encroachment in a residential area. In an effort to make <br />concessions and come to a compromise, the residents met with Mr. Biskirbd to draw <br />up a list of deed restrictions. Mr. Biskind said he would allow 100 feet from <br />the beginning of his property on Columbia Road; fifty feet of that would be open <br />land. Behind the open, grassy area would be a mound with ].arxiscaping. The <br />rendering shown to the residents was quite nice. Mr. Skoulis felt this infor- <br />mation on the setback and landscaping should go into the record in ease the land <br />was sold and developed by someone other than Mr. Biskind. <br />George Papandreas, a representative of Biskind Development Company, agreed that <br />the company had met with residents to try and hear what they had to say and be <br />sensitive to what some of their fears might be.
