<br />Council Minutes of 12/3/91 <br />~~;; <br />Law Director Gareau reported: 1) With respect to the Eliza Jennings case, have <br />comrnuiicated with Judge Gaul's office and indicated that we would like the judge <br />to proceed and rule on the motions arxl cross motions for summary judgment rather <br />than attempting to compromise and settle that case. <br />2) Recently received a communication from the EPA dealing with the Matousek land- <br />fill case. A rnunber of years ago, the Federal government tried to impose the cost <br />of abating the leakage of methane gas upon the cities who contributed to that <br />landfill. Our share of the negotiated settlement was $16,000; however, the <br />settlement was not approved in Washington. it has been reconsidered, and a <br />lawsuit will be filed. Once all the parties involved are served, we will settle <br />the matter; our share will still be $16,000. <br />3) Next week we have an argument before the Court of Appeals in Franklin County <br />regarding the school guard issue. <br />4) This Friday will attend, along with Assistant Law Director Dubelko, a one-day <br />municipal law seminar to be held in Columbus. <br />5) Recent developments have surfaced relative to the Star Lounge; will have <br />further comments during the Safety Committee report. <br />Finance Director Burns reported: 1) Last tmnth, Council approved the roll over of <br />$3,000,000 notes into $2,900,00 worth of notes. These notes were sold, and the <br />pre-closing was held today. The interest rate on the notes is 4.39X. <br />Council President Boehmer announced that the next Council meeting would be changed <br />from Tuesday, December 17, to Wednesday, December 18. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Commvttee <br />reported: 1) A public hearing was held at 7 p.m. this evening with regard to <br />Ordinance No. 91-132, which is the rezoning of land at the corner of Country Club <br />Blvd. and Columbia Road. Council feels that the agreement, along with the deed <br />restrictions, will be beneficial to the residents. <br />2) A BZD Committee meeting will be held on Monday, December 9, at 7:30 p.m. to <br />discuss the Viewpoint development. <br />Mr. McKay, Chairperson of the Environmental Committee reported: 1) The <br />Environmental Committee met on Tuesday, November 26, for the purpose of reviewing <br />Ordinance No. 91-152 and Resolution No. 91-153. In attendance were Council <br />Members Lind and McKay and Service Director Boh].marzn. <br />a. Ordinance No. 91-152 defines more clearly the contaminating oils that are <br />dumped in City sewers and also spells out the process by which the City may enter <br />premises to monitor the discharge, make inspections, and take samples. The <br />Committee recommends passage of this ordinance. <br />b. Resolution No. 91-153 authorizes the Director of Public Service to advertise <br />for bids for the purpose of conti.rnvs~g the repair of City sanitary sewer lines. <br />The Committee feels it is necessary to continue this work in order to reduce <br />flooding and recommends passage of this resolution. <br />2 <br />
