f <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTID <br />NOVF~IBER 4, 1992 <br />Present: Council President Boehmer, Council Members Bahas, Leonard, Lind, <br />McKay, Musial, Nashar <br />Also Present: Mayor Ed Boyle (8:20 p.m.), Law Director Michael Garesu, Finance <br />Director James Burns, Clerk of Council Barbara Seman <br />Absent: Council Member Saringer <br />Council President Boehmer called the meeting to order at 8:04 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the meeting of October 20, 1992 were approved as written. <br />President Boehmer announced that Ordinances 92-159, 92-160, 92-161 would be <br />passed under suspension of the rules. <br />Law Director Gareau reported: 1) A pretrial in Halleen Chevrolet's BZA appeal <br />was held on October 13. Halleen has also requested a hearing to have additional <br />evidence a~iitted. The Law Department has filed a brief in opposition. <br />2) The Eliza Jennings brief has been filed in the Court of Appeals. <br />3) A brief was filed for ,su~n[nary judgment in the Marc's Funtime Pizza case. <br />4) A reply brief was filed in the Court of Appeals with regard to the criminal <br />case of the City of North Olmsted vs. Gable. A motion for the Rocky River Court <br />to suppress evidence in this case has been granted, and the Law Department feels <br />this was not an appropriate action. <br />5) With regard to the Packard false arrest case, a motion had been filed for <br />summary judgment asking that the city be dismissed. Before the court could grant <br />the motion, the plaintiff dismissed the city out of the case. 'The Police officer <br />is still a party to the case, and it is being covered by insurance. <br />6) A new false arrest case has been filed, Gilbert vs. the City of North Olmsted. <br />7) The firefighters had filed an unfair labor practice against the City of North <br />Olmsted with regard to prescription coverage provided by Kaiser. However, that <br />complaint has. been withdrawn. <br />8) The Engineering Department is working on a continuing program of identifying <br />cross connections in the sewer system. Most residents willingly discoct; how- <br />ever, in a few situations, we must take legal action. Recently wee filed for a <br />mandatary injunction against a resident on Elm Road. The Enginesring and Law <br />Departments will continue to vigorously pursue these cases. <br />Finance Director Burns reported: 1) Ordinances 92-159 and 92-160, which will be <br />passed under suspension of the rules, deal with the balance of the rues that <br />will be coming due on December 18. These notes will be renewed for a two year <br />period. Because we are currently issuing bonds, all the paper work will be in <br />place allowing the city to issue notes for greater than a nine month period with- <br />out incurring additional cost. <br /> <br />
