A f <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTID <br />- SEPTEMBER 15, 1992 <br />Present: Council President Boeh~ner, Council Members Bahas, Leonard, McKay, <br />Musial, Nashar, Beringer <br />Also Present: Mayor Ed Boyle, Law Director Michael Gareau, Finance Director <br />James Burns, Clerk of Council Barbara Semen <br />Absent: Council Member Lind <br />Council President Boehmer called the meeting to order at 8:02 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the meeting of Tuesday, September 1, 1992 were approved as <br />written. <br />President Boetuner announced that Ordinance No. 92-127 and Resolution Nos. 92-129, <br />92-130, and 92-132 would be passed under suspension of the rules. <br />Mayor Boyle reported: 1) The County has advised the city that our local <br />government fund allocation for 1993 is going to be $882,190.22. This will be <br />a 13% increase over the allocation for 1992 of $780,709.27. <br />2) The city will dispose of residents' appliances containing freon at no cost to <br />the residents. All the resident has to do is call City Hall, and the appliance <br />will be picked up and disposed of legally and properly. <br />3) The Greater Cleveland Regional Transit Authority has sent the city a draft of <br />their long-range plan, RTA Transit 2010. This plan details their major bus and <br />rail projects for the next 25 years. <br />Law Director Gareau reported: 1) The city recently received a lawsuit dealing <br />with a dispute regarding hospitalization coverage for President of Council <br />Boehmer. We will adjourn into executive session later in this meeting to discuss <br />this matter. <br />2) Last week we received an opinion regarding the North Olmsted Firefighter's <br />case dealing with the request by Capt. Richard Smith for vacation time credit due <br />to his National Guard service. Originally, the amount of vacation back pay <br />requested was approximately $14,000. The Court of Appeals had ruled that the <br />employee was entitled to National Guard credit time; however, the time should be <br />calculated on the basis of actual time served. That would have amounted to a <br />couple of weeks of vacation pay of approximately a thousand. dollars. However, <br />this ruling was appealed to the Supreme Court. The city filed a cross appeal to <br />protect the city's rights with respect to several legal issues. In its ruling of <br />last week, the Supreme Court upheld the city's assertion that the six-year <br />statute of limitations had run out. Also, the Supreme Court ruled that, instead <br />of following the rules and laws regarding vacation time accrued for state <br />
