Council Minutes of 9115/92 <br /> <br />employees, the rules dealing with vacation time of the municipal corporation <br />should have been followed. The case has been remanded back to the Court of <br />Appeals to make a finding by applying the rules of the City of North Olmsted <br />with regard to granting vacation time for part-time service in the National <br />Guard. Since the city does not give vacation time for part-time service, there <br />wi]1 probably be no monetary award. <br />3) Next Tuesday, September 22, the private detective case will be argued before <br />the Supreme Court. <br />4) Safety Director Gandy ar~d Police Chief 5efcek have given depositions dealing <br />with the case of Marc's Funtime Fizza. Since the last court date, Mares has <br />paid the license fee that was owed. Briefs will soon be filed, arxi the case will <br />proceed in the court system. <br />Finance Director Burns reported: 1) Before Council tonight is Ordinance 92-127, <br />a transfer ordinance which includes a transfer of $175,000-from the Bus Fund to <br />the General Fund. Also, an additional $15,000 in the Drug Enforcement Fund and <br />$6,000 in the Law Enforcement Fund will be appropriated. The money available i.ri <br />the Drug Enforcement Fund is due to forfeitures and seizures that the Police <br />Department has made in the drug enforcement program. <br />Mrs. Beringer, Chairperson of the Building, Zoning and Development Committee, <br />reported: 1) The committee met on Monday, September 14, with members Nashar and <br />Beringer in attendance. One agenda item was discussed: <br />a. Szarka's Restaurant at 29691 Lorain Road has been sold and will be reopened <br />under the name, Corso's. Mr. Les Szarka and Mr. Ingrassia, the contractor, were <br />present also. The assembly plat proposal to c~nbine two permanent parcels into <br />one was approved by the Planning Commission on September 8. The BZD Committee <br />had no abjection to this proposal. A 20 x 36 foot addition to be constructed on <br />the existing building was approved by the cosrimittee. The BZA has granted a 10 <br />foot side yard variance for landscape buffer. Also, a 30 foot setback variance <br />has been granted to construct the addition. A summary of the revisions is as <br />follows: <br />- The ARB required a rear office to be painted or sided from green to a cream <br />color--this is in front of the walk at the north elevation. <br />- The BZA is requiring a six foot solid privacy fence to run the length of the <br />property; a safety rail to run the length of the property; the trash enclosure <br />to be moved to the center of the property; one parking light is to be redirected. <br />- The Planning Commission is requiring the handicapped parking spaces to be <br />properly marked; additional striping of the parking lot; a revision of the <br />landscape plan; the privacy fence to be board on board. as suggested by the <br />Department of Forestry. <br />Because of a previous problem with sidewalk maintenance, the owners have agreed <br />to repair the sidewalks when the foundation for the addition is done. The <br />committee had no objections and moved to approve the plans. <br />2 <br />
