Council Minutes of 06-15-2010 <br />• No special storm-induced brush round-up has been announced. Brush should <br />continue to be bundled for garbage collection. <br />• Streets are being patched and swept. In-house crack sealing has begun. <br />Director of Law Gareau: <br />• The Charter Review Commission has issued their report, and has made fourteen <br />recommended changes to the Charter. Those changes that will appear on the <br />ballot should be delivered to the Board of Elections no sooner than July 2, 2010 <br />and no later than September 3, 2010. He recommends the Committee of the <br />Whole meet and forward their recommendations to the Law Dept. for legislation. <br />• The Law Dept. has completed and filed the 2009 report to the Auditors of State to <br />demonstrate claims and potential claims facing the city. They also completed and <br />filed an agency technical assistance performance questionnaire for HUD to <br />maintain compliance with North Olmsted's fair housing compliance program. <br />• A grievance has been filed by AFSCME concerning distribution of overtime. The <br />complaint states that overtime was allegedly offered to the first and thirteenth <br />employees on the overtime list in violation of the collective bargaining agreement. <br />A hearing is set for June 17, 2010. <br />• The Law Dept. is currently reviewing the peddlers, canvassers and solicitors <br />Ordinance to ascertain any developments in that area of law. <br />• The Law Dept. has received complaints about Platinum Protection Service, a <br />security system entity that is soliciting throughout North Olmsted. One of the <br />trends is solicitation will occur, a sale will be commenced and then within twenty <br />minutes someone shows up to install the security system. Ohio's Home <br />Solicitation Act gives three days to rescind the contract when there is a home <br />solicitation made. If they are installing twenty minutes later, that seems to be a <br />violation. They have ceased going door-to-door at this point. <br />• The Law Dept. is currently reviewing North Olmsted's public records policy. <br />• There has been seven new referrals made to the Law Dept. for prosecution of <br />property maintenance violations. They are working with the owners to gain <br />compliance. <br />• On June 3, 2010, the Board of Zoning Appeals upheld the Building <br />Commissioner's finding that the Surf Shop is operating outside of its approved <br />occupancy permit by changing from a business use to an assembly use. They <br />further found and upheld the Building Commissioner's recommendation and <br />finding that they failed to obtain necessary building permits. The next step will <br />be an appeal to the Court of Common Pleas by the Surf Shop. <br />• An arbitration hearing for an AFSCME grievance regarding staffing and hours at <br />the Waste Water Treatment Plant has been scheduled for Monday, August 23, <br />2010 at 10:00 a.m. <br />• At the last meeting, he reported out on two commercial properties that have been <br />to the Law Dept. for review -the Stearns & Lorain plaza and the Surf Shop plaza. <br />There were extremely large arrearages in tax payments.
