.:~ Council Minutes of 06-15-2010 $44,115,332.00. Councilman Barker made a motion to recommend approval with suspension of Ordinances 2010-69, 70, 71, 72 & 73. The motion to recommend approval of 2010-69, 2010-71 and 2010-73 was seconded by Councilwoman Jones. The motion to recommend approval of 2010-70 and 2010-72 was seconded by Councilman Kearney. The committee voted 3-0 to approve all Ordinances. The meeting adjourned at 7:20 p.m. Councilwoman Jones, Chairwoman of the BZD Committee: The BZD Committee met on Tuesday, June 15, 2010 at 7:00 p.m. Present were Committee members Jones and Barker; President Limpert; Council members Brossard, Kearney, Orlowski and Williamson. • CMS10-13 Clearwire -This proposal consists of a wireless antenna installation on the rooftop of the Westbury Apartment Building. Because there are already more than three installations on the roof, this proposal is considered to be a conditional accessory use. The new installation will be located along the western corner of the roof and match the type of installations that have been previously approved. Additionally, the applicant proposes to remove eight antenna and microwave dishes that are not functioning or are in disrepair. Screening was not provided as the existing installations were not screened, and the applicant does not feel it will have a visual impact at ground level. The Planning Commission and City Council felt the removal of the obsolete antenna would be a visual improvement to the site. Councilwoman Jones made a motion to recommend approval of a conditional accessory use for CMS10-13 Clearwire. The motion was seconded by Councilman Barker and it passed 2-0. Councilwoman Jones made a motion to approve CMS10-13 Clearwire located at 25151 Brookpark Road; the conditional accessory use of a wireless antenna installation. The motion was seconded by Councilman Barker and passed unanimously. CMS10-13 Clearwire approved. • CMS10-14 Welcome House -This proposal consists of a request for a conditional use permit for an adult day habilitation center to be located in an existing building in the Water Tower Square Plaza. No exterior changes to the building or site are being proposed. There is no development plan review or approval required. Types of conditional uses are outlined in Section 1135.01(c) of the one and two- family residential district, which are also considered conditional uses in the general business retail district. This proposal would fall under the welfare category. Chapter 1118 outlines the general criteria and standards for review. They include physical and operational compatibility consistent with design standards and development regulations that will not impede the normal and orderly development of surrounding property for uses permitted in the district, traffic circulation, adequate public facilities and adequate screening. It was the City Planner's opinion that the proposal met all of Chapter 1118 general criteria and standards. All activities of the facility will be carried on in the inside of the building.
