Council Minutes of 06-15-2010
approximately and inch and two inch has very small masonry screws that the
manufacturer of the screws says they're not appropriate; only to be used for interior dry
and non-structural use. No report from the engineer has ever countered the short nails or
screws. The railing manufacturer established the bolt size, type and length they felt
would be necessary to pass the load test (Superior Railing Co.). Two weeks ago he left a
message with an inspector to call him back with the length and type of mounting screws
that are used on the outside and inside. Mr. Mitchell called him back about four days
later and said they don't know what was used, but he would follow up on it. As of today
he hasn't received an answer. He spoke to the engineer at Superior Aluminum Product
and he stated that Key Construction wanted shorter, cheaper bolts approved in the design
for the railings for the mounting as the other ones were going to cost too much. There is
no change order for the shorter screws and bolts but they ended up with them anyway.
The one bolt is not compatible with the aluminum. The one on the outside is stainless
steel, but it is too short; did not pass the requirements. Simpson Strong Tie, Deck Tech,
and the manufacturer of the railings gave them paperwork indicating the warranties are
null and void if their directions are not followed. President Limpert said four weeks ago
he had requested the Administration get Council a report that was provided, and he is
under the impression that this was all handled. Mayor Kennedy said he understood Mr.
Fisher would be at the Council meeting two weeks ago, so he had Building
Commissioner Mitchell in attendance of the Council meeting to answer any questions.
Fisher said if he would have known that, he would have attended the meeting. Mayor
Kennedy said Fisher can always come to city hall and he and Mitchell will review these
issues with him.
Gene Schmidtke, 26705 Leenders Lane wanted to know if there is a way to find out what
is going to be on the Council meeting agenda. He had contacted the Council office to
find out if a particular issue .was going to be on the agenda and the Clerk was not sure.
Mayor Kennedy said Council receives their agenda on Friday and the agenda is
distributed on Monday. He asked if there is a certain issue that Mr. Schmidtke has. The
Clerk can E-mail the agenda to him on Monday. Director of Law Gareau said the issue
he thinks Mr. Schmidtke is referring to will surface in a committee report as opposed to a
piece of legislation which is listed on the agenda. Gareau said he contacted Mr.
Schmidtke's Homeowner's Association regarding the issue and to bring any concerns to
his attention. The Clerk would not be aware of each and every item that might be
reported out and addressed in a committee report because it is not listed on the agenda.
President Limpert agreed.
Dennis Lambert, 25057 Carey Lane referenced Ordinance 2010-79. He is in complete
opposition of serving alcoholic beverages in a public park. The argument he has heard is
that they serve alcohol at the fairground. Lambert said fairgrounds and other similar
events are gated affairs. People come and go through a gate. A public park is open all
day long to children on bicycles coming and going through the park and people driving
cars to get there. It sets a bad precedent to serve alcoholic beverages in a public park and
then allowing people to get in their automobiles and drive home.
7
