<br />Council Minutes of 04-20-2010 <br />The first proposal before the committee was CMS 10-07, Fish Furniture, 23770 <br />Lorain Road, which consists of an addition to an existing non-conforming <br />building and site improvements. The two story building addition will be <br />constructed at the rear of the building and will consist mainly of an integrally <br />colored concrete block. The existing block on the north and west elevation will <br />be painted to match the new addition. The area where the addition is proposed is <br />currently unpaved. In addition to the building improvement, the remainder of the <br />lot will be surfaced with asphalt, and curbing and landscaping will be installed. A <br />new dumpster enclosure will be added which will be constructed from block with <br />a concrete cap and wood gates. No additional site lighting is proposed; the <br />addition will have wall lights. The building addition is 7,900 square feet square <br />feet. The existing building already exceeds the lot coverage maximum of 25% for <br />the general retail business district. With the addition, lot coverage is 45%. <br />Required parking for a commercial building of this size is 114 spaces. The <br />applicant has 45 spaces on their property and also has the rights to 35 spaces on <br />their neighbor's property due to a cross easement agreement, for a total of 80 <br />spaces. Therefore, the proposal required a variance of 34 spaces. The applicant <br />and staff had discussed the possibility of adding parking along the rear property <br />line in the area that is shown as green space. This would have caused an <br />additional variance for rear parking setback. It was agreed by the applicant and <br />staff that due to the low actual parking need for the business that the area should <br />remain green space. As the building is non-conforming, the addition required a <br />special permit from the BZA to add to anon-conforming building. Variances <br />were also obtained for insufficient parking, excessive lot coverage and deviation <br />from 1165.02 as the addition fails to comply with the required lot coverage. Upon <br />further investigation, it was found that the applicant had submitted and the <br />Planning Commission had approved a lot consolidation during the review process <br />for the last building expansion. The plat was never recorded. The City Engineer <br />has requested a new plat be submitted and filed. Council applauded the applicant <br />for added to the floor space and investing in our community. In addition, the <br />plans submitted show that 3 crab apple trees will be planted in the rear <br />landscaping area; the Planning and Design Commission recommended 5 to be <br />planted but the Committee discussed that 3 should be sufficient and changed that <br />condition. Councilwoman Jones moved to recommend approval of Fish <br />Furniture, including the recommendations by the Boards and Commissions with <br />the exception of changing the number of crab apple trees from 5 to 3, and <br />including the special permit from the BZA. Councilman Mahoney seconded the <br />motion and it passed 3-0. <br />Councilwoman Jones made a motion to approve CMS I 0-07 Fish Furniture located at <br />23770 Lorain Road with the following conditions: a lot consolidation of all three lots, <br />consider flaring/angling of loading dock retaining wall to accommodate truck deliveries, <br />modification of north elevation to lower the wall light, plant 3 crab apple trees along the <br />rear landscape area, planting size for trees are to be a minimum of 2 inch caliper and the <br />arborvitaes are to be 5 to 6 fees tall when planted. Existing trees are to be shown on the <br />plans and those being removed and marked and including the special permit granted by <br />6 <br />
