"'° <br />Council Minutes of 03-16-2010 <br />unanimously. Miguel Cora appointed to the Cultural Activities Commission for the <br />unexpired term of January 1, 2009 to December 31, 2013. <br />AUDIENCE PARTICIPATION <br />Terry Groden, 25211 Chase Drive said there is currently legislation being discussed in <br />Columbus known as House Bill 366 which would exempt school districts from having to <br />pay for unfunded mandates -particularly in this case, the requirement to provide all day <br />kindergarten. He asked Council and/or the Administration to consider drafting legislation <br />urging lawmakers in Columbus to approve this legislation. There is no concrete proof <br />that all day kindergarten has any long term educational merit. In addition to House Bill <br />366, he asked that everyone urge lawmakers to stop and/or reverse any legislation for <br />unfunded mandates that would unnecessarily burden taxpayers to pay for educational <br />programs that don't have long term educational merit. <br />Dennis Lambert, 25057 Carey Lane asked if anybody had the ballot issue number for the <br />Charter change. Mayor Kennedy and Law Director Gareau said the ballot issue number <br />is 34. <br />Jay Piatak, 23853 David Drive said he's an owner of a condominium in the North Woods <br />Complex. The Board is currently involved in a balcony repair project that he and more <br />than a few owners have serious questions about. There are documents in front of the <br />Building Commissioner now pointing out serious material problems and code questions <br />that they can't get answers to. He would like to know if they can ever expect any <br />answers, and if there are problems, how can this project be allowed to go forward until <br />these problems have been addressed? Have there been any inspections by the city since <br />this project started, because mistakes have literally been covered up by aluminum trim <br />and soffit materials. He as well as his Councilman Larry Orlowski have been told that <br />everything is fine. He has documentation dated 1981 that states there is termite damage <br />on the joists and the balconies, and the current repair plan is sistered over fifty percent of <br />this rotten wood. There was a plan previous to this one that completely replaced all three <br />sections of the balcony and canopy that would have eliminated the rotten wood and <br />termite damage. That plan was completely disregarded and the current plan put in <br />motion. It has been brought to his attention that there was already an incident in North <br />Olmsted where a balcony collapsed and killed someone. That building was relatively <br />new; ten or fifteen years old. His complex is forty seven years old. The wood that is <br />being reused and sistered on their balconies is forty seven years old. He has photographic <br />evidence of the hallway in his building leaking through the new repair. He was told by <br />the Building Department that there was an inspection and no problem. There is a <br />problem there and he would like to know how it will be fixed. Mayor Kennedy said he <br />will sit down with Dr. Thomas and Mr. Piatak and figure out the problem. <br />10 <br /> <br />
