Council Minutes of 10-18-2011 <br /> <br />scheduled to reopen October 24, 2011 but that date will be pushed back at least <br />one week. <br />Director of Law Gareau: <br />• In the matter of Eugene Dzambasow vs. Brian Bielozer, et al a case management <br />conference has been scheduled on November 9, 2011 at 1:30 p.m. in the U.S. <br />District Court in Youngstown. <br />• He has been working with Jane Leaver, Administrative Assistant to Mayor <br />Kennedy, to review prevailing wage procedures in the city. He has prepared a <br />memo for directors for distribution. <br />• There are five new property maintenance referrals for prosecution. Two are for <br />the removal of hazardous trees, one unlawful sign, one grass complaint and one <br />junk car citation. <br />• The Law Dept. has initiated contact with the State of Ohio Bureau of <br />Underground Storage Tank Regulations. They were contacted because of the <br />former Clark gas station at Stearns and Lorain. The Ohio Revised Code prohibits <br />abandoned stations from re-opening unless a bond is filed to ensure compliance <br />with certain codes and to make sure public safety is being maintained. <br />Director of Finance Copfer: <br />• No report. <br />Councilman Mahoney, Chairman of the Building, Zoning & Development Committee: <br />The BZD Committee met Tuesday, October 18, 2011 at 7:15 p.m. Present were <br />committee members Mahoney, Barker and Kearney; Council President Limpert; Council <br />members Orlowski, Schumann, and Brossard; Mayor Kennedy, Director of <br />Planning/Development Wenger and Director of Safety/Service Thomas. <br />• CMS11-20 Destination XL -This is a plan for site improvements to a store <br />location that is going in at the Olmsted Plaza Shopping Center. Casual Male will <br />be moving across the street, and Eddy's Bicycle will expand their operations and <br />rent the remainder of Casual Male. The committee voted 3-0 for approval of <br />CMS 11-20 Destination XL. <br />Councilman Mahoney made a motion to approve CMS 11-20 Destination XL. The <br />motion was seconded by Councilman Barker and passed unanimously. CMS11-20 <br />Destination XL approved. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane said regarding abandoned gas stations, there may be <br />some regulations in the EPA requiring those tanks to be removed from the ground within <br />2 <br />._ _ . <br />._. .. , ~, <br />
