. ^~~. <br />,u <br />Council Minutes of 10-04-2011 <br />Bill Tanruther, 24761 Arlington Lane said he is a retired consulting engineer and is very <br />familiar with the type of problem Joseph Soltesz referred to. The pipe is made of a <br />material called oangeburg pipe by a company in Orangeburg, New York. It's a wood <br />fiber and sometimes asbestos impregnated with asphalt. Its maximum life expectancy <br />has always been 50 years or less. It was installed in 1970 and going on 40 years. It was <br />not encased in concrete or sand so it's deteriorating. The problem will not go away until <br />it is replaced by pvc pipe. <br />LEGISLATION <br />Resolution 2011-94 introduced by Councilman Schumann was given its third reading. A <br />Resolution directing the Auditor of Cuyahoga County to pay to the City of North <br />Olmsted, Ohio, during the year 2012, all money due and owing said city from any <br />collection source. Councilman Barker moved for adoption. The motion was seconded by <br />Councilman Kearney and passed unanimously. Resolution 2011-94 adopted. <br />Ordinance 2011-96 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance dispensing with an RFP process and authorizing the Mayor to enter into a <br />contract with Johnson, Miller & Schmitz LLP providing for the latter to continue to serve <br />as the City's labor negotiator, and declaring an emergency. Councilman Barker moved <br />for adoption. The motion was seconded by Councilman Schumann. Roll Call: Barker, <br />yes with comment. This is a tool for the Administration to use. Council has approved <br />this before and it should be approved again. In fact, our Safety Director said we need Mr. <br />Johnson at the table and he used to be a union negotiator. Mr. Johnson has saved this city <br />money over the years from what the Mayor has showed us in committee and what the <br />Finance Director presented us with more detailed information today. The money saved <br />helped with our budget and gave us more money to help serve the residents and saved our <br />taxpayers money. In my opinion, probably saved from additional layoffs due to our <br />current and future economic conditions. Council lowered elected officials' salaries three <br />years ago and this year to show leadership. We should again show leadership by giving <br />the Administration the tools needed. Future negotiations are going to be difficult, and our <br />bargaining units will have professionals working for them and so should the <br />Administration. Ohio Revised Code stipulates that our job as legislators is to approve the <br />contract that is agreed upon by the Administration and union involved. It does not state <br />we can withhold the funding needed to make sure the Administration is on equal ground. <br />Ohio Revised Code 4117.10(c) states the Chief Executive Officer or Chief Executive <br />Officer's representative of each municipal corporation; the designated representative of <br />the Board of Education of each school district, college or university or any other body <br />that has authority to approve the budget of their public jurisdiction; the designated <br />representative on the Board of County Commissioners and of each elected office holder <br />of the County whose employees are covered by the collective negotiations and the <br />designated representative of the Village or Board of Township Trustees of each township <br />is responsible for negotiations in the collective bargaining process except that the <br />legislative body may accept or reject a proposed collective bargaining agreement when <br />the matter is about which there is an agreement reduced to writing and approved by the <br />7 <br />~~~ ~ ~~ <br />
