Council Minutes of 04-OS-2011 <br />Administration have taken many steps to move the City forward, but he feels the hearing <br />was a big step backward. Mayor Kennedy said one of the things that's important to know <br />is he did say he was going to post that. At that point, the Chief did not give his <br />resignation and had not even gone to the pension board. That is why the City waits until <br />there is a vacancy. Mayor Kennedy said my sister sits on a board or commission. Had <br />she done what Ubaldi did, she would have been removed. Smith said he didn't actually <br />post it. Mayor Kennedy asked Smith what he thought about a police officer driving down <br />the road with a guy with a gun that you know he's going to kill someone. Do you think <br />he should wait until he kills him? Smith said well a gun is pretty serious. Mayor <br />Kennedy said this is serious to for taxpayer's purposes because the last thing they need is <br />aboard or commission member running the Administration. Smith said the commission <br />is independent of the Administration. Mayor Kennedy said so they can just hire people <br />as they like and Smith said no; they are not supposed to have the political influence of the <br />Administration. Gareau said there is not prohibition from the Administration walking up <br />and speaking to the Civil Service Commission. The Administration is permitted to <br />suggest rule changes. The Civil Service Commission is free to do as it chooses as to <br />whether or not they adopt that rule. That is not political influence. The question is what <br />if you ignore what the Law Director tells you and you are wrong? In this case I stand by <br />the fact that he was wrong and so does the Mayor. <br />LEGISLATION <br />Ordinance 2011-23 introduced by Mayor Kennedy on behalf of himself, the President of <br />Council and the entire City Council was given its third reading. An Ordinance <br />establishing a special revenue fund in the City of North Olmsted to accumulate funds in <br />order to compensate municipal employees in those calendar years when a 27`h payment of <br />salary and benefits occurs, and declaring an emergency. Councilman Barker moved for <br />adoption. The motion was seconded by Councilman Kearney and passed unanimously. <br />Ordinance 2011-23 adopted. <br />Ordinance 2011-24 introduced by Mayor Kennedy on behalf of himself, the President of <br />Council and the entire City Council was given its third reading. An Ordinance <br />establishing a special revenue fund in the City of North Olmsted to accumulate funds in <br />order to pay to qualifying municipal employees at separation accumulated sick leave, <br />vacation time and payments in lieu of compensatory time, and declaring an emergency. <br />Councilman Barker moved for adoption. The motion was seconded by Councilman <br />Kearney. Roll Call: Barker, yes with comment. These two ordinances are a big asset <br />that will help the City of North Olmsted plan for future large expenditures. I commend <br />the Administration and Finance Dept. and the Law Dept. for bringing this together. My <br />vote is yes. Roll Call continued: Kearney, yes; Schumann, yes; Orlowski, yes; <br />Mahoney, yes; Brossard, yes; Williamson, yes. Ordinance 2011-24 adopted. <br />Ordinance 2011-27 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance authorizing the Director of Planning and Development to solicit bids for the <br />demolition and removal of dangerous buildings located at 5430 Sunset Oval as a public <br />6 <br />
