Council Minutes of OS-21-2013 • Discussed was Ordinance 2013-42 which is an Ordinance amending Part Nine, Title One (Streets and Sidewalk Areas) of the Streets, Utilities and Public Services Code of the City of North Olmsted so as to add a new Chapter 900 and to amend existing Chapters 901, 903, 90S and 909, for in order to clarify required fees and deposits, and declaring an emergency, as amended. Director Wenger gave a very thorough explanation of why this Ordinance is necessary to update our Code in an effort to clarify required fees and deposits. This Legislation will allow us to accurately recapture real costs and fees associated with projects. There were no concerns expressed by anyone present. Councilman Brossard made a motion to recommend approval which was seconded by Councilman Orlowski, and the committee voted 3-0 to recommend approval of Ordinance 2013-42. This Ordinance was later amended during the Council meeting of May 7, 2013. The Streets Committee met Tuesday, May 14, 2013 at 7:1 S p.m. Present were committee members Brossard, Orlowski and Williamson; Council President Jones; Council members Barker, Schumann and Kearney; Planning/Development Director Wenger, Safety/Service Director Thomas, Mayor Kennedy and guests. • Discussed was Ordinance 2013-46 which is an Ordinance amending Chapter 931 of the Streets, Utilities and Public Services Code of the City of North Olmsted entitled, "Grading and Surface Water Drainage" in order to amend required fees and deposits, and declaring an emergency. Planning/Development Director Wenger explained how this Ordinance allows the city to accurately recapture real costs and fees while eliminating specific references of rates for engineering because those rates are unique for each individual project and will evolve over time. Guest Jim Burns made a suggestion to change some language of the Ordinance, specifically rate established by engineering contract. Wenger clarified that because not all engineering projects are contracted out, the existing language and reference to engineering division is sufficient. Councilman Brossard made a motion to recommend approval which was seconded by Councilman Orlowski, and the committee voted 3-0 to recommend approval of Ordinance 2013-46. Councilwoman Williamson, Chairwoman of the Public Safety, Health & Welfare Committee: The Public Safety Committee met Tuesday, May 14, 2013 at 8:00 p.m. Present were committee members Williamson and Schumann; Council members Brossard, Kearney and Orlowski; Mayor Kennedy, Safety/Service Director Thomas, Planning/Development Director Wenger and guests. • Discussed first was liquor permit no. SS42888 for Mariola Burgers North Olmsted, LLC dba Rail located at 400 Great Northern Mall. After review by Lt. Cox at the police dept. and seeing no issues with the applicant, a motion was recommended to not object to the issuance of the liquor permit. Councilwoman Williamson made a motion to not object to liquor permit no. SS42888 for Mariola Burgers North Olmsted, LLC dba Rail. The motion was seconded by 4
