Council Minutes of OS-21-2013 <br />• Discussed was Ordinance 2013-42 which is an Ordinance amending Part Nine, <br />Title One (Streets and Sidewalk Areas) of the Streets, Utilities and Public <br />Services Code of the City of North Olmsted so as to add a new Chapter 900 and <br />to amend existing Chapters 901, 903, 90S and 909, for in order to clarify required <br />fees and deposits, and declaring an emergency, as amended. Director Wenger <br />gave a very thorough explanation of why this Ordinance is necessary to update <br />our Code in an effort to clarify required fees and deposits. This Legislation will <br />allow us to accurately recapture real costs and fees associated with projects. <br />There were no concerns expressed by anyone present. Councilman Brossard <br />made a motion to recommend approval which was seconded by Councilman <br />Orlowski, and the committee voted 3-0 to recommend approval of Ordinance <br />2013-42. This Ordinance was later amended during the Council meeting of May <br />7, 2013. <br />The Streets Committee met Tuesday, May 14, 2013 at 7:1 S p.m. Present were committee <br />members Brossard, Orlowski and Williamson; Council President Jones; Council <br />members Barker, Schumann and Kearney; Planning/Development Director Wenger, <br />Safety/Service Director Thomas, Mayor Kennedy and guests. <br />• Discussed was Ordinance 2013-46 which is an Ordinance amending Chapter 931 <br />of the Streets, Utilities and Public Services Code of the City of North Olmsted <br />entitled, "Grading and Surface Water Drainage" in order to amend required fees <br />and deposits, and declaring an emergency. Planning/Development Director <br />Wenger explained how this Ordinance allows the city to accurately recapture real <br />costs and fees while eliminating specific references of rates for engineering <br />because those rates are unique for each individual project and will evolve over <br />time. Guest Jim Burns made a suggestion to change some language of the <br />Ordinance, specifically rate established by engineering contract. Wenger <br />clarified that because not all engineering projects are contracted out, the existing <br />language and reference to engineering division is sufficient. Councilman <br />Brossard made a motion to recommend approval which was seconded by <br />Councilman Orlowski, and the committee voted 3-0 to recommend approval of <br />Ordinance 2013-46. <br />Councilwoman Williamson, Chairwoman of the Public Safety, Health & Welfare <br />Committee: <br />The Public Safety Committee met Tuesday, May 14, 2013 at 8:00 p.m. Present were <br />committee members Williamson and Schumann; Council members Brossard, Kearney <br />and Orlowski; Mayor Kennedy, Safety/Service Director Thomas, Planning/Development <br />Director Wenger and guests. <br />• Discussed first was liquor permit no. SS42888 for Mariola Burgers North <br />Olmsted, LLC dba Rail located at 400 Great Northern Mall. After review by Lt. <br />Cox at the police dept. and seeing no issues with the applicant, a motion was <br />recommended to not object to the issuance of the liquor permit. <br />Councilwoman Williamson made a motion to not object to liquor permit no. SS42888 for <br />Mariola Burgers North Olmsted, LLC dba Rail. The motion was seconded by <br />4 <br /> <br />
