Council Minutes of 04-16-2013 <br />one acre lot requirement was amended to remove the section pertaining to <br />=-~ nuisance conditions, only prohibit domestic farm animals on properties less than <br />3/4 of one acre of land and amended the list of prohibited animals and exempted 5 <br />or less chickens on properties that are less than 3/4 of one acre of land. These <br />changes were welcomed by many of the residents, though several still had <br />concerns regarding the restrictions. Council heard from many additional residents <br />and members of 4H clubs regarding the proposed restrictions. While these <br />restrictions were lessened from the original version of the ordinance, members of <br />the 4H clubs were requesting the city to reconsider the Ordinance and adopt <br />various other guidelines for raising farm animals on domestic properties. These <br />guidelines are useful in other circumstances, but did not adequately deal with the <br />present issue of possessing numerous and varied types of domestic farm animals <br />on residential properties having less than '/a of an acre of land. A motion was <br />made and passed 2-0 to hold this legislation in committee. The meeting <br />adjourned at 8:51 p.m. <br />• The Public Safety Committee met for the final time to discuss Ordinance No. <br />2013-17, on March 11, 2013, at 7:04 p.m. Present were committee members <br />Williamson and Schumann; Council members Brossard, Barker, Schumann, <br />Orlowski and Kearney; Law Director Gareau and guests. The committee heard <br />from several individuals, including 4H groups and an advocate from the Council <br />on Arab-Islamic Relations of Ohio regarding the current proposal. Again, it was <br />requested that this committee continue the discussions of adopting Less restrictive <br />"~ guidelines to accommodate each of these organizations. The committee heard <br />~ from residents who currently have more than the proposed number of chickens on <br />properties less than 3/4 of one acre of land. The Law Director disagreed with the <br />suggestion that this particular piece of legislation is discriminatory toward any <br />particular individual. He advised that the Ordinance is neutral on its face and is a <br />law of general applicability. It is an ordinance that was designed to address the <br />legitimate public safety concerns of odor and noise associated with raising <br />animals on small parcels of property, in very close proximity to adjacent parcels <br />of land. The committee voted 2-0 in favor of holding the proposed ordinance in <br />committee to allow the Law Director to review additional recommendations. The <br />meeting was adjourned at 8:23 p.m. Tonight, we will have the Ordinance before <br />us for consideration with the following amendments: The increase of chickens up <br />to a total of ten for lot sizes smaller than 3/4 of an acre. Additionally, the "fowl" <br />limitation was removed. The section as it concerns "fowl" is now limited to <br />regulations on ducks, geese, chickens and turkeys only for lots under'/4 of an acre. <br />Councilwoman Williamson made a motion to remove Ordinance 2013-17 from <br />committee and place it on this evening's agenda for second reading. The motion was <br />seconded by Councilman Schumann and passed unanimously. Ordinance 2013-17 <br />removed from committee and placed on agenda for second reading 7-0. <br />Councilwoman Williamson made a motion to amend Ordinance 2013-I7 by changing the <br />lot size requirements, removing the emergency clause, removed the word "or" between <br />domestic and farm animals in the third Whereas clause, in Section 1 under 505.19(a) in <br />5 <br /> <br />
