Council Minutes of 04-16-2013 the first sentence to add after domestic farm animal means the following "excluding all of the language which includes any animal identified and regulated by ORC, in number 5 of Section (a) to remove "or other fowl" and add "geese or ducks", in part (b) to add "except as exempted herein, it shall be unlawful for any person or persons upon a parcel of land" and adding "less than 3/4 of one acre in size", at the end of part (b) after the word "animals" to add "For purposes of this section, when calculating three quarters (3/4) of one (1) acre of a parcel of land, contiguous parcels of land, without intersecting streets, shall constitute three quarters (3/4) of one (1) acre of a parcel of land if such parcels are titled to the same person or entity. This prohibition shall not apply to persons with ten (10) or less chickens (hens only) on a parcel of land less than three quarters (3/4) of one (1) acre in size", Section (c) is removed in its entirety. Former Section (d) is now Section (c), Section (e) is now Section (d) and Section 2 is removing the emergency clause. The motion was seconded by Councilman Schumann and passed unanimously. Ordinance 2013-17 amended 7-0. AUDIENCE PARTICIPATION Cliff Crabs, 25575 Butternut Ridge Road referenced Ordinance 2013-17. He suggested that "Bovine" and "Equine" be inserted in the Ordinance when referring to cows and horses. Gareau said he has no objection if Council would entertain this suggestion. The sponsor, Councilman Brossard, and Safety Chair, Councilwoman Williamson, had no objection. "~ Councilwoman Williamson made a motion to include in Ordinance 2013-17 in paragraph (a)4 "Bovine" for Cows and "Equine" for horses. The motion was seconded by Councilman Schumann and passed unanimously. Ordinance 2013-17 amended 7-0. Nicole Wright, 5320 Stanard Avenue wanted two items clarified. She asked if that on lots less than 3/4 of an acre if 10 or less chickens are allowed for any lot size? Gareau said correct. She asked if the listed domestic farm animals are allowed on parcels greater than 3/4 of an acre? Gareau said yes. LEGISLATION Ordinance 2013-32 introduced by Mayor Kennedy was given its third reading. An Ordinance amending Chapter 159 of the Codified Ordinances of the City of North Olmsted entitled "Cultural Activities Commission" in order to rename the Commission, redefine membership qualifications and establish new duties. Councilman Orlowski moved for adoption. The motion was seconded by Councilwoman Williamson and passed unanimously. Ordinance 2013-32 adopted 7-0. Ordinance 2013-17 introduced by Councilman Brossard was given its second reading. An Ordinance establishing Section 505.19 "Domestic Farm Animals Prohibited" of Chapter 505 of the General Offenses Code entitled "Animals and Fowl," in order to prohibit domestic farm animals on parcels of land in the City less than three quarters (3/4) of one (1) acre, as amended. 6
