Council Minutes of 09-04-12 <br />. thru should be improved as well. He thanked Gareau for referencing the shared facilities <br />_,,~ agreement between the City of North Olmsted and the school district. The school district <br />is eager to move forward on that agreement. The agreement will be forwarded to the city <br />soon. <br />Brian Hagan, 3926 Mark Avenue, Rocky River said during the past several months' <br />Mayors Court discussions, he bristled at some of the comments that were made such as <br />the Mayors Court can be run more efficiently than Rocky River Court. There have been <br />no members of Council that have said Rocky River Court has done anything that is <br />inefficient. He also bristles at the comment that North Olmsted pays for several members <br />of employees at Rocky River Court. Rocky River does not accept any checks from any <br />suburb or district for any employees of the court. He challenges the Mayor and Finance <br />Director to show him a cancelled check. Rocky River operates solely upon the people <br />that use the court. He reiterated Chief Justice Moyers statement that there is the <br />appearance of impropriety and the separation of powers where the executive branch <br />assumes responsibilities of the judiciary. A Magistrate in the Mayors Court is an <br />employee of the city and an employee of the Mayor. The Prosecutor in the Mayors Court <br />is also an employee of the city of North Olmsted. Besides Cuyahoga Falls, this will be <br />the first Mayors Court established in the state of Ohio in 30 years. Cuyahoga Falls did it <br />out of spite. He hopes and knows there is no spite here because they have worked very <br />well with the suburbs here. <br />,,, Debbie Comery, 22600 Marlys Drive, Rocky River said she really doesn't have any <br />comments this evening. Everything she has said has already been said in this Chamber or <br />through writings through records requests, etc. She said if Council has any questions as <br />they deliberate this evening, she would be very happy to answer them. <br />Judy Nash, 30000 Shadow Creek, Westlake quoted Cleveland's Police Chief as saying a <br />few weeks ago "we can't arrest our way out of these problems" referring to mental <br />health, substance abuse, poverty and violence..."The cost of crime is great, but the loss <br />of services for the defendants and families and communities is even greater because it has <br />both intangible and tangible costs". The cost of crime estimates show even modest <br />reductions in certain types of crime can generate substantial economic benefits. She <br />urged each Council member to think beyond politics and money, and to think about <br />North Olmsted, the people of North Olmsted and what the loss would include when part <br />of the city is gone from the court and what that means to the greater good. <br />LEGISLATION <br />Ordinance 2012-47 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance amending and re-establishing Chapter 131 of the Administrative Code entitled <br />"Mayor" in order to provide for the establishment of a Division of Mayor's Court, and <br />declaring an emergency. Councilman Mahoney moved for adoption. The motion was <br />seconded by Councilman Kearney. Roll Call: Mahoney, no with comment. Everyone <br />here knows I have been against this proposal from the start. First of all, I would indicate <br />briefly that I commend the Mayor for bringing this initiative forward.
