Council Minutes of 08-21-12 <br />unanimously. Councilman Schumann moved for adoption. The motion was seconded by <br />Councilman Barker and passed unanimously. Resolution 2012-63 adopted. <br />Ordinance 2012-64 introduced by Councilman Barker was given its second reading. An <br />Ordinance amending Section 1367.11 of Chapter 1367 (Satellite Dish Receiving Stations) <br />of the Building Code, entitled "No Permit or Fee Required for Certain Types of Satellite <br />Dish Antennae," in order to establish safety restrictions and to regulate the location of <br />direct broadcast satellites. Councilman Mahoney made a motion to suspend the rule <br />requiring three readings. The motion was seconded by Councilman Kearney and passed <br />unanimously. <br />Dennis Lambert, 25057 Carey Lane said he hasn't looked at the Ordinance and does not <br />know to what extent Council is regulating. The Federal Communications Act strictly <br />prohibits any interference with the reception or transmission of radio signals. He does <br />not believe municipal law supersedes federal law. He heard the report where it was <br />stated that the Ordinance is in compliance with those things. He hopes it is because it's <br />going to send some people who are told they cannot have a satellite dish in a certain area <br />and they can't receive a signal into a situation where they have to go to court and plea not <br />guilty on the grounds that it's not the jurisdiction of the city to regulate that. <br />Councilman Mahoney moved for adoption. The motion was seconded by Councilman <br />Kearney and passed unanimously. Councilman Barker thanked the Law Dept. for their <br />help on this Ordinance. Ordinance 2012-64 adopted. <br />Ordinance 2012-66 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending Section 135.05 of Chapter 135 of the Administrative Code entitled <br />"Department of Finance" in order to further authorize petty cash expenditures within the <br />Division of Springvale Golf Course, and declaring an emergency. Councilman Barker <br />made a motion to suspend the rule requiring three readings. The motion was seconded by <br />Councilman Schumann and passed unanimously. Councilman Barker moved for <br />adoption. The motion was seconded by Councilman Kearney and passed unanimously. <br />Ordinance 2012-66 adopted. <br />Ordinance 2012-67 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending and re-establishing Chapter 155 of the Administrative Code entitled <br />"Parks and Recreation Commission" in order to amend the duties and meeting <br />requirements of the Parks and Recreation Commission. <br />Ordinance 2012-68 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2012, and <br />declaring an emergency, as amended. Councilman Barker made a motion to suspend the <br />rule requiring three readings. The motion was seconded by Councilman Schumann and <br />passed unanimously. Councilman Barker moved for adoption. The motion was seconded <br />by Councilman Schumann and passed unanimously. Ordinance 2012-68 adopted. <br />
