Council Minutes of 08-07-12 <br />motion was seconded by Councilman Kearney and passed unanimously. CMS2012-13 <br />Sunnyside Toyota located at 26890 Lorain Road approved. <br />• Discussed next was CMS2012-14 Sunnyside Toyota located at 4877 Dover <br />Center Road. This proposal consists of demolishing an existing vacant building <br />and various site improvements (pavement, landscaping, mailbox and chain link <br />fence on the south side of the property). The Planning and Design Commission <br />approved this with the following conditions: consolidation of the two parcels <br />would be submitted an approved, vehicle delivery trucks are prohibited from <br />accessing the lot, any new signage would be submitted for approval by the <br />Planning and Design Commission and all engineering requirements would be met <br />and thought would be given to a bio-retention system. <br />Councilman Mahoney made a motion to approve CMS2012-14 Sunnyside Toyota site <br />improvements with conditions set forth by the Planning and Design Commission. The <br />motion was seconded by Councilman Barker and passed unanimously. CMS2012-14 <br />Sunnyside Toyota located at 4877 Dover Center Road approved. <br />Councilman Brossard took a moment of personal privilege. On July 14, 2012 he had the <br />privilege of being a player/Manager for the CERT baseball team during the Friends of the <br />Community Foundation Public Safety Softball Tournament held during Fairview Park's <br />Summer Fest. They had 2 wins and g losses. <br />AUDIENCE PARTICIPATION <br />Jennifer Rudolph, 3329 Walter Road suggested funding the Mayor's Court for two years <br />and then assess how well it does after the first two years to see if the city should continue <br />to have a court. Mayor Kennedy said you can stop funding it at any time. <br />Judy Nash, 33000 Shadow Creek, Westlake said she is a probation officer for Rocky <br />River Court. She said she is thinking about this from a human side and not the money <br />side. She thinks what North Olmsted will lose by having a Mayor's Court will not gain <br />in money. She deals with extreme cases every day -the human side of what they deal <br />with in Rocky River Court. Fifty percent of first time DUI offenders have an alcohol <br />problem. If you send a person to a three-day driver intervention program, they have no <br />ability to have analcohol/drug assessment. Nash said Rocky River Court is also focused <br />on protecting the public and trying to keep crime rates down. She stated re-offense rates <br />were 4% across the board out of 200 cases they reviewed. She said Mayor's Court will <br />not assess the problems of substance abuse, mental health, poverty, etc. Out of those 200 <br />cases, 102 OVI offenders were reviewed and only 2.5% had re-offended in a four-year <br />period. Nash said another issue is when you're running a court to make money, you're <br />going to reduce cases because it's not about justice. It's about money. She does not want <br />to be at Great Northern Mall and be around people that are stealing on a regular basis <br />causing prices to go up; the repeat offenses they see when there is not good intervention. <br />Councilman Mahoney made a motion to allow Nash an additional 5 minutes speaking <br />time.
