Council Minutes of 06-OS-12 <br />,~,~ and Burns replied that his request went to the Clerk of Council and she apparently <br />referred it to the City Engineer and the City Engineer is who Burns was corresponding <br />with. Burns did not suggest this was intentional. The Mayor indicated that Brian Blum <br />laid out a very logical case for this legislation and Councilman Schumann agreed. <br />Councilman Kearney made a motion to remove the legislation from the agenda and place <br />it back into committee. The motion was seconded by Councilman Orlowski. The Clerk <br />of Council requested to speak to clarify for the record that she did in fact receive an E- <br />mail request from Burns for the EPA documentation, and that Brian Blum responded to <br />Burns, not the City Engineer as Burns had previously indicated. The Clerk read the E- <br />mail from Blum that was sent to Burns dated May 11, 2012 (attached). Councilman <br />Kearney withdrew his motion to amend the agenda to remove Ordinance 2012-42 and <br />Councilman Orlowski withdrew his second. <br />LEGISLATION <br />Ordinance 2012-41 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance abolishing Chapter 169 of the Administrative Code of the City of North <br />Olmsted entitled "Litter Control and Recycling Advisory Council." Councilman <br />Schumann moved for adoption. The motion was seconded by Councilman Mahoney and <br />passed unanimously. Ordinance 2012-42 adopted. <br />Ordinance 2012-42 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance amending Section 917.99 entitled "Penalty" of Chapter 917 entitled <br />~~ "Industrial Pretreatment" of the Streets, Utilities and Public Services Code in order to <br />'~ eliminate affirmative defenses to treatment violations. Councilman Schumann moved for <br />adoption. The motion was seconded by Councilman Mahoney and passed unanimously. <br />Ordinance 2012-42 adopted. <br />Ordinance 2012-44 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2012, and <br />declaring an emergency. Councilman Mahoney made a motion to suspend the rule <br />requiring three readings. The motion was seconded by Councilman Schumann and <br />passed unanimously. Councilman Mahoney moved for adoption. The motion was <br />seconded by Councilman Schumann and passed unanimously. Ordinance 2012-44 <br />adopted. <br />Resolution 2012-45 introduced by Mayor Kennedy was given its second reading. A <br />Resolution authorizing the Director of Planning and Development to advertise for bids <br />for the award of a contract to provide new gateway signage at various locations in the <br />city, as detailed in the specifications on file in the Planning Department, and authorizing <br />the Mayor, following approval of the Board of Control to contract for the same with the <br />lowest and best bidder, and declaring an emergency. Councilman Schumann made a <br />motion to suspend the rule requiring three readings. The motion was seconded by <br />Councilman Kearney and passed unanimously. <br />;.~, <br />4 <br /> <br />
