MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTID <br />WIDNESDAY, I~VII~IIt 3, 1993 <br />Present: Council President Boehm+er, Council Members Bahas, Leonard, Lind, <br />McKay, Musial, Nashar, Beringer <br />Also Present: Mayor Ed Boyle, Law Director Michael Gareau, Finance Director <br />James Burns, Clerk of Council Barbara Semen <br />Council President Boehmer called the meeting to order at 8:03 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the meeting of October 19, 1993 were approved as written. <br />Mr. Boehmer announced that Ordinance No. 93-141 would be passed under suspension <br />of the rules. <br />Law Director Gareau reported: 1) The firefighters union has filed an action with <br />the State Employees Relations Board asking that the city negotiate the impact of <br />the no smoking ordinance an the firefighters working conditions. Mr. Gareau has <br />filed a lawsuit in Common Pleas Court asking for a declaratory judgment action <br />indicating that it is not within the purview of the union to require the city to <br />negotiate health, safety and welfare actions passed by City Council. He has <br />prepared, but not yet filed, a restraining order and preliminary injunction. Mr. <br />Gareau feels that it is in the best interest of the city to have these issues <br />decided in a court of law. The actions being taken are not meant to be an~i- <br />union, but rather to protect the integrity of City Council. <br />2) With regard to the Nova case, the Common Pleas Court granted the motion <br />requiring Nava Corporation to make a more definite statement indicating whether <br />the basis of their lawsuit is tort or contract. Nova was given ten days to <br />reply, but has not yet dorms so. Consequently, Mr. Gareau will move to have their <br />complaint stricken from the record for failure to file the amended complaint <br />within the ten day period. <br />Finance Director Bu rns reported: 1) Numerous municipalities and counties <br />throughout Ohio have become involved in an investment called an "interest only <br />strip." Mr. Burns has not chosen to invest in such products, but rather to <br />remain with more stable investments such as CD' s and Federal agencies. <br />2) On October 21, the second of three hard drives of the Finance Department <br />computer system broke down and. had to be replaced. The department has been <br />working diligently to rebuild and restore all files. The payroll system is up <br />and going, and the payroll for this week will not be delayed. <br />3) On Friday, November 5, the subcommittees for RTA and the City will meet to <br />determine the wording for the new contract that will take effect on January 1, <br />1994.
