Council Minutes of 10/19/93 <br /> <br />6) The city has received a letter of representation regarding a false arrest <br />case. The issue is being investigated. However, we feel that the city has a <br />valid, defendable case. <br />7) We have filed an Emerald Health subrogation claim for approximately $5,000. <br />Finance Director Burns reported: 1) Each year we go through a budget hearing <br />process with the county; however, the County Auditor has notified the city that <br />they are not able at this point to certify .the property taxes. The reason for <br />the delay is that the county has been notified that it will have a $54 million <br />reduction in property taxes regard3aag utilities this year. The reason for this <br />reduction could be one of the following or a combinations of bath: a change in <br />the percentage of appraised value that is currently taxed; a change in the way <br />microwaves and overland wires are taxed for telephone utilities. The approximate <br />37X reduction in collection equates to an approximate $125,000 reduction in <br />property taxes for the city. <br />Mr. Lind. reported for Mrs. ginger, Chairperson of the Building, Zoning and <br />Development Committee: 1) The committee met on October 7; and in att+nce were <br />committee members; Councilman McKay; Building Commissioner Conway; Assistant <br />Engineer McDermott. Agenda items were as follows: <br />a. Society National Bank, 26401 Brookpark Road, a proposal to construct a free- <br />standing building on the former Putt-Putt site. Presenting the plaza was <br />architect Brad Smith and attorneys George Papandreas and Togn Belden. T7~e <br />landscape plan had been approved by Mr. Zergott; and, consequently, a}~roved by <br />the BZD Committee. The committee had ~ objections to the plan. Mr. Lfnd moved <br />to approve with all the recommendations of the Plaiming Commiasicm, ARB, axxl. <br />incorporating the changes made in the revised drawings dated September 28, 1993; <br />second by Mr. Nashar; motion passed unanimously. <br />b. United Methodist Church, 4600 Dover Center Road, a proposal to construct an <br />additional parking area. Floyd Andrews, chairperson of the church building <br />committee, presented the plans far an additional 44 to 46 parking spaces <br />immediately west of the present lot. There is a problem with the draix~age that <br />must be resolved. The committee felt that the 30 foot light poles weere too high <br />and requested the poles be rio higher than 20 feet. The light fixtures will be <br />enclosed on the sides to eliminate glare. The committee had no objections as <br />long as all of the committee, Planning Commission and ARB rec toms are <br />followed. Mr. Lind moved to approve the plan providing ali the rec tions <br />are followed and that the drainage problem be resolved with the Engineering <br />Department; second by Mr. Nashar; motion passed unanimously. <br />c. Ordinance 93-1.04 which restricts the location of used car lots. A letter <br />from Pat Graham, president of the Chamber of Commerce, was read. The casmmi.ttee <br />had no objections to the legislation which had been referred to the Planning <br />Commission. <br />d. Ordinance 93-116 which concerns improvements to parking areas. The committee <br />had rio objections to the legislation which had been referred to the Planning <br />Commmisson. <br />e. Ordinance 92-58 which deals with recreational vehicles. Twenty-two residents <br />were in attendance and contributed constructive criticism and suggestions. The <br />Building Commissioner will revise the ordinance, and it will be discussed further <br />at a future committee meeting. <br />3 <br />~~;..-:. <br />
